RESOLUTION NO. 8746
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH APPROVING THE
DESTRUCTION OF CERTAIN RECORDS IN CUSTODY
• OF THE CHIEF OF POLICE
• WHEREAS, there are certain records under control
of the Chief of Police which are no longer required to be
kept; and
WHEREAS, Section 34090 of the California Government
Code provides that the head of a City Department, with the
approval of the legislative body by Resolution, and the
written consent of the City Attorney, may destroy records
without making a copy thereof; and
WHEREAS, the City Attorney has consented to the
destruction of the records requested by the Chief of Police;
and
WHEREAS, it is hereby found and determined that the
records requested to be destroyed by the Chief of Police are
no longer required to be kept;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that the Chief of Police is hereby
authorized to destroy the following described records, without
making a copy thereof, and the City Council approves the
destruction of said records, which are described as follows:
All records which were reported prior to January 1,
1971, and more particularly described as follows:
1. All traffic collision reports except those
involving a death, an arrest, or city property or liability.
2.
All
found property reports.
3.
All
animal related reports.

4.
All
suspicious incident reports.
5.
All
stored, impounded or repossessed vehicle
reports.

6. All injury reports except those involving a
death or city property or liability.
7. All property for safekeeping reports.
ADOPTED this 12th day of April , 1976
