A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH DECLARING ITS INTENTION TO
• ORDER THE VACATION AND ABANDONMENT OF A SEGMENT
OF AN EXISTING 10 -FOOT WIDE ALLEY NORTHEASTERLY
OF WEST COAST HIGHWAY BETWEEN ORANGE STREET AND
• COLTON STREET, AND SETTING A PUBLIC HEARING FOR
AUGUST 9, 1976
The City Council of the City of Newport Beach under
the provisions of the "Public Service Easements Vacation Law"
and amendments thereto, Section 50430 et seq. of the California
Government Code, does hereby resolve and declare as follows:
SECTION 1. The public interest and convenience require,
and it is the intention of the City Council of the City of
Newport Beach to order the vacation and abandonment of a segment
of an existing 10 -foot wide alley within Resubdivision No. 520,
northeasterly side of West Coast Highway between Orange Street
and Colton Street in the City of Newport Beach, which parcel
is more particularly described as follows:
"A strip of land, 10.00 feet in width, measured
at right angles, being a portion of the alley
in Block 7 of the Seashore Colony Tract as said
tract is shown on a map recorded in Book 7,
Page 25 of Miscellaneous Maps in the office of
the County Recorder, County of Orange, State of
California; the northwesterly line of said strip
is more particularly described as follows:
Beginning at the most easterly corner of Lot 12
of Block 7 of said tract, thence southwesterly
along the southeasterly lot lines of Lot 12, 13
and 14, said line terminating on the southeasterly
lot line of Lot 14 at the northeasterly corner of
the parcel of land described in a deed recorded
in Book 382, Page 20 of Official Records of said
County:"
Said segment of the existing 10 -foot wide alley to
be vacated and abandoned is shown on a certain map entitled
• "Alley Vacation" prepared by the City of Newport Beach, Public
• Works Department, dated June 30, 1976, a copy of which is
attached hereto, marked Exhibit "A" and incorporated herein by
this reference.

SECTION 2. The proceedings for the vacation and
abandonment of said segment of an existing 10 -foot wide alley
are taken pursuant to, and the City Council of the City of
Newport Beach elects to proceed under the provisions of, the
"Public Service Ed.sement Vacation Law" and all amendments thereto,
being Sections 50430 to 50445, inclusive, of the California
Government Code.
SECTION 3. The Public Works Director of the City of
Newport Beach shall cause to be conspicuously posted along the
line of said easement proposed to be vacated and abandoned, not
more than three hundred (300) feet apart, and not less than
three (3) in all, notices of the vacation and abandonment of
said easement. The notices shall state the passage of this
Resolution of Intention and the time and place of the hearing
before the City Council of all persons interested in or objecting
to the proposed vacation and abandonment. Said notice shall be
posted at least ten (10) days before the date of said hearing.
SECTION 4. Notice is hereby given that the City Council
of the City of Newport Beach does hereby fix Monday, the 9th
day of August, 1976, at the hour of 7:30 P.M. on said day in the
Council Chambers located in the City Hall of the City of Newport
Beach at 3300 Newport Boulevard, Newport Beach, California, as the
time and place for hearing all persons interested in or objecting
to the proposed vacation and abandonment of said segment of an
existing 10 -foot wide alley.
SECTION 5. A notice of the hearing hereinabove set,
giving the date, time and place of said hearing, shall be published
by the City Clerk in the official newspaper of the City once each
week for at least two successive weeks prior to said hearing.
