RESOLUTION NO. 8846
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ORDERING THE VACATION AND
ABANDONMENT OF AN EXISTING SIDEWALK EASEMENT
BETWEEN BAYSIDE AND THE BALBOA ISLAND CHANNEL
APPROXIMATELY 850 FEET WESTERLY OF MARINE AVENUE
WHEREAS, the City Engineer presented to the City
Council of the City of Newport Beach on June 28, 1976, a
certain map prepared by the Public Works Department of the
City of Newport Beach, identified as Drawing No. R /W- 5338 -L
dated June 17, 1976, showing a 5 -foot wide sidewalk easement
along the westerly edge of Lot 2 of Tract No. 8073 which had
been originally dedicated to serve as one possible means of
providing an accessway connecting Bayside Drive to a public
walkway along the Balboa Island Channel and which the City
is considering vacating; and
WHEREAS, the City Council of the City of Newport
Beach approved and adopted said map on June 28, 1976, and
directed the City Clerk to file same in the proceedings for
the abandonment of said existing sidewalk easement; and
WHEREAS, on July 26, 1976, the City Council held
a public hearing for the purpose of hearing all persons
interested in or objecting to the proposed vacation and abandon-
ment of said above - described sidewalk easement; and
WHEREAS, the City Council finds and determines from
all of the evidence submitted that the subject sidewalk described
herein and more particularly in Resolution No. 8809 is unneces-
sary for present or prospective public use.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Newport Beach that said sidewalk, more particularly
described as:

"A strip of land being a portion of Lot 2
Tract 8073, as shown on a map recorded
in Book 327, pages 8 and 9 of Miscellaneous
Maps in the Office of the County Recorder,
County of Orange, State of California, said
• strip being the most westerly 5.00 feet, of
said lot, measured at right angles from the
westerly line thereof.
• The easterly line of said strip being prolonged
or shortened to terminate in the northerly and
southerly lines of said Lot 2."
is hereby ordered vacated and abandoned.
BE IT FURTHER RESOLVED that the Clerk is hereby
ordered to cause a certified copy of such order attested by the
Clerk under the seal of the City to be recorded in the Office
of the County Recorder of the County of Orange.
