A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH AUTHORIZING THE
EXECUTION OF AN AMENDMENT TO THE DECLARATION
• OF COVENANTS, CONDITIONS AND RESTRICTIONS
OF TRACT 4692 (PARK LIDO) AND AUTHORIZING
THE DIRECTOR OF COMMUNITY DEVELOPMENT TO
CONSENT TO FUTURE PROPOSED AMENDMENTS PROVIDED
THE AMENDMENTS DO NOT IN ANY WAY PREJUDICE OR
REDUCE THE CITY'S RIGHTS UNDER THE DECLARATION
OF COVENANTS, CONDITIONS AND RESTRICTIONS
WHEREAS, on June 18, 1962 the City Council of the
City of Newport Beach adopted Resolution No. 5614 authorizing
the execution of the Declaration of Covenants, Conditions and
Restrictions being imposed upon Tract 4692, which Resolution
is recorded in Book 6161, Page 575, Official Records of Orange
County; and
WHEREAS, the Board of Directors of Park Lido Associa-
tion, Inc., have requested the City Council of the City of
Newport Beach to consent to an amendment to the Declaration of
Covenants, Conditions and Restrictions, which amendment provides
for an alteration in the makeup of the assessment lien while
preserving the City's interest in perpetual upkeep and mainten-
ance of the common area in said development; and
WHEREAS, the City Council has reviewed the proposed
amendment and determines that it does not affect or delete from
the permanent upkeep, maintenance and payment of taxes for the
common area of Tract 4692; and
WHEREAS, it is determined that the Community Development
Director may be authorized to execute future proposed amendments
to said Declaration of Covenants, Conditions and Restrictions
provided that the proposed amendment in no way deletes from the
• adequate provisions for the permanent upkeep, maintenance and
payment of taxes for the common area of Tract 4692;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and
City Clerk be and are hereby authorized and directed to execute
the Certificate of Second Amendment of Declaration of Covenants,
Conditions and Restrictions for Park Lido, Lots 1 through 99,
inclusive, Tract 4692, Orange County, California.
BE IT FURTHER RESOLVED that the Community Development
Director of the City of Newport Beach be and is hereby authorized
to execute future amendments to the Declaration of Covenants,
Conditions and Restrictions recorded against Tract 4692 on
condition that any proposed amendment so authorized shall not,
in any way, delete from adequate provisions for the payment of
upkeep, maintenance and taxes on the common area of Tract 4692.
BE IT FURTHER RESOLVED that the City Clerk is hereby
authorized and directed to prepare a certified copy of this
Resolution, transmit it to the Board of Directors of Park Lido
for recordation along with the Certificate of Second Amendment
of Declaration of Covenants, Conditions and Restrictions for
Park Lido, Lots 1 through 99, inclusive, Tract 4692, Orange
County, California.
