HomeMy WebLinkAbout9767 - General Municipal Election - 4-8-80RESOLUTION NO. 9767 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH RECITING THE FACT OF THE Is GENERAL MUNICIPAL ELECTION HELD IN SAID CITY ON THE 8TH DAY OF APRIL, 1980, DECLARING THE RESULT THEREOF, AND SUCH: OTHER MATTERS AS ARE PROVIDED BY LAW • WHEREAS, a regular general municipal election was held and conducted in the City of Newport Beach, County of Orange, State of California, on Tuesday, the 8th day of April, 1980, as required by law; and WHEREAS, notice of said election was duly and regu- larly given in time, form and manner as provided by law; that voting precincts were properly established; that election offi- cers were appointed; and that in all respects said election was held and conducted and the votes cast thereat, received and can- vassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in cities; and WHEREAS, pursuant to Resolution No. 9757 adopted the 24th day of March, 1980, the City Clerk canvassed the returns of said election and has certified. the results to this City Council, and said results are received, attached and made a part hereof as Exhibit "A," NOW, THEREFORE, the City Council of the City of Newport Beach DOES RESOLVE as follows: SECTION 1. That there were forty -three (43) voting precincts established for the purpose of holding said election, consisting of thirty -seven (37) consolidations and six (6) regular election precincts in the City of Newport Beach as established for the holding of state and county elections. SECTION 2. That said regular general municipal election was held for the purpose of electing the following officers of said City as required by the laws relating to the cities in the State of California, to wit: Three members of the City Council of said City for the full term of four years. SECTION 3. That at said regular general municipal election, the following measures.were submitted to the electors of said City, to wit: Four proposed Charter Amendment measures, designated as City Measure A through City Measure D. SECTION 4. That the whole number of votes cast in said City, except absent voter ballots, was 15,042; that the whole number of absent voter ballots cast in said City was 578, making a total of 15,620 votes cast in said City. SECTION 5. That the names of persons voted for at said election for Members of the City Council are as follows: District Two District Five District Seven Robert L. Brockman Dick Clucas Ruthelyn Plummer David Shores Lee Watkins Philip R. Maurer Paul Ryckoff John C. Cox, Jr. Jeffrey Kenneth Gaynor Ray E. Williams That the measures voted upon at said election are as follows: CITY MEASURE A: Shall City Measure A, which amends certain sections of the City. Charter, to change the date of election from the second Tuesday in April of even - numbered years to coincide with local school board elections on first Tuesday after the first Monday in November of odd - numbered years be ratified? ' CITY MEASURE B: Shall City Measure B, which amends certain sections of the City Charter, to reduce the cost of living increases in the amounts now allowed as reimbursement for expenses incurred by the Mayor and City Councilmen and delegating authority to City Council to adjust the amounts based on the Consumer Price Index or an annual five percent increase, whichever is lesser, be ratified? CITY MEASURE C: Shall City Measure C, which amends Section 401 of the City Charter to change the eligibility to hold office as a member of the City Council, subject to certain restrictions, be ratified? -2- CITY MEASURE D: Shall City Measure D, which amends certain sections of the City Charter, to change the date of election from the second Tuesday in April of even - numbered years to coincide with the state -wide general election on the first Tuesday after the first Monday in November in even - numbered ' years, be ratified? That the number of votes given at each precinct and the number of votes given in the City to each such persons above named for the respective officers for which said persons were candidates and for and against the measures were as listed in Exhibit "A" attached. that: SECTION 6. The City Council DOES DECLARE AND DETERMINE RUTHELYN PLUMMBER was elected as a Member of the City Council from the Second District for the full term of four years. PHILIP R. MAURER was elected as a Member of the City Council from the Fifth District for the full term of four years. JOHN C. COX, JR., was elected as a Member of the City Council from the Seventh District for the full term of four years. That as a result of said election, the ,vote on the proposed charter amendment measures above described was as follows: A majority of the qualified voters voting on City Measure A did not vote in favor thereof, and it was not adopted. A majority of the qualified voters voting on City Measure B did vote in favor thereof, and it was adopted. A majority of the qualified voters voting on City Measure C did vote in favor thereof, and it was adopted. A majority of the qualified voters voting on City Measure D did vote in favor thereof, and it was adopted. I% SECTION 7. The City Clerk shall enter on the records of the City Council a statement of the result of said election showing: (1) The whole number of votes cast in the City; -3- SECTION 8. The City Clerk shall immediately make and, upon compliance by the persons elected with the provisions of Section 11550 and Section 11554 of the Elections Code of the State of California relating to the filing of campaign state- ments, shall deliver to each of such persons so elected a Certi- ficate of Election signed by her and duly authenticated, shall administer to each person elected the Oath of Office prescribed in the State Constitution of the State of California, and shall have them subscribe thereto and file the same in her office. WHEREUPON, each and all of said persons so elected shall be inducted into the respective offices to which they have been elected.
