Brown, City Clerk APPROVED: 'p,_� TITLE: APPOINTMENTS TO THE ENVIRONMENTAL QUALITY AFFAIRS COMMITTEE ABSTRACT: On November 27, 2012, the City Council adopted Resolution No. 2012 -116 which established the Environmental Quality Affairs Committee ( "EQAC "). The City Council directed that appointments to EQAC be made in January 2013; however, since only four applications were received, the City Council extended the appointment date and directed that the vacancies be re- advertised. RECOMMENDATION: a) Waive the portions of Council Policy A -2 (Board and Commission Appointments) which establishes a Council Ad Hoc Appointments Committee and requires two or more applications for each vacant seat. b) Consider the applications received in the City Clerk's Office by the February 15, 2013 deadline. C) Make appointments via paper ballot to EQAC pursuant to City Council Policy A -2. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. Appointments to EQAC February 26, 2013 Page 2 DISCUSSION: The newly established EQAC was adopted by the City Council at the November 27, 2012 City Council meeting. EQAC's purpose is to advise the City Council on policies, programs and projects that improve or detract from the environmental quality of the City, as requested by the City Council; comment on Notices of Preparation, as requested by the City Council; and meet as needed to consider issues referred to them by the City Council. The City Clerk posted the initial Notice of Vacancies in the City Clerk's Office, the Library, the City Hall bulletin board, and on the City's webpage on Monday, December 17, 2012; and published the notice in the Daily Pilot on Saturday, December 22, 2012. The deadline to submit applications was Thursday, January 9, 2013. For the seven vacancies, only four applications were received by the deadline. At the January 22, 2013 City Council meeting, the City Clerk was directed to re- advertise for the vacancies so that more applications may be considered. On Thursday, January 24, 2013, the Notice of Vacancies was posted in the City Clerk's Office, the Library, the City Hall bulletin board, and on the City's webpage. The Notice of Vacancies was published in the Daily Pilot on Saturday, January 26, 2013. EQAC EQAC will be comprised of seven members from various geographical areas of the City appointed by the City Council and two non - voting Council Members appointed by the Mayor, subject to confirmation by the City Council. The Mayor will also appoint one of the two non - voting Council Members as the Chair of EQAC. The City Council confirmed Mayor Curry's appointments to EQAC of Council Member Nancy Gardner (Chair) and Council Member Tony Petros at the January 8, 2013 City Council meeting. The seven members appointed by the City Council would serve a four -year term with a limit of two consecutive terms. The two non - voting Council Members would each serve a one -year term. The committee would be subject to the open meeting laws of the Ralph M. Brown Act. Since nine applications were received by the close of the application period, staff is recommending that the City Council waive the portion of Council Policy A -2 (Board and Commission Appointments) which establishes a Council Ad Hoc Committee to review the applications and make recommendations to the City Council, and the portion of Council Policy A -2 that requires two or more applications for each vacant seat. The City Council will vote on all EQAC appointments simultaneously. The voting will be by paper ballot and the City Clerk will tabulate and announce the results, including the vote tally. B. Each member of the City Council will cast a maximum of seven votes for EQAC on the paper ballot. In order to be appointed, the applicant must receive at least four votes. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Having lived in Newport Beach for several years now, I feel a close connection to the city that I call home. Part of what makes this city great is the successful integration of business, residence, and nature. This delicate balance must be maintained, and kept consistent with the discernment that has been observed in past years. Progress must be encouraged and, with this mind, we must also be able to curb as much of the impact of this progress on the surrounding environment as possible. I believe the duty of the board is to give the best and most comprehensive information to our city leaders so they are most able to accomplish that. I believe my unique position of currently serving the public has allowed me to observe the views of those from across the spectrum including those that believe we should "build, build, build" and those that would like us to reverse progress and eradicate a human presence in many places. I do not find myself at either extreme, but I believe a level- headed approach, made possible by comprehensive research and investigation, is always the best approach. I think strong community is foundational to all that really counts in life. I see EQAC as a way to show my willingness to work constructively and be involved in a meaningful way. The manner in which we deal with environmental issues will determine our children's future. 3) 1 worked In the steel recycling Industry for nearly 20 years and In addition to trading metals, i managed large scrap recycling Industries in Detroit, Iowa and Southern California.
