A RESOLUTION OF THE CITY COUNCIL OF THE CITY
it OF NEWPORT BEACH EXPRESSING THE CITY'S
OPPOSITION TO SB799 (MELLO) AND SB999
(CAMPBELL) WHICH REPRESENT AN ATTEMPT BY THE
STATE TO PREEMPT THE ABILITY OF LOCAL
AUTHORITIES TO PERMIT OR PROHIBIT FIREWORKS
SALES
WHEREAS, SB799 (Mello) and SB999 (Campbell) are
presently pending before the State :Legislature, which Bills may
be amended to preempt local authority to permit or prohibit
fireworks sales; and
WHEREAS, the sale of fireworks can have a significant
adverse affect upon the public health, safety and general welfare
of the City of Newport Beach; and
WHEREAS, it is appropriate for local authorities to
themselves decide whether to permit or prohibit sales of
fireworks; and
WHEREAS, it is a matter of local concern and not State-
wide concern whether to permit or prohibit the sale of fireworks,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the City opposes SB799 (Mello) and
SB999 (Campbell) should those Bills be amended in an attempt to
preempt local control of the sale of fireworks.
BE IT FURTHER RESOLVED that copies of this Resolution
shall be sent to the Orange County Division of the League of
California Cities, the League of California Cities and Newport
Beach's legislative delegation.
