• RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH SUMMARILY VACATING A WATERLINE
EASEMENT AT THE SOUTHEASTERLY CORNER OF
BAYSIDE DRIVE AND MARINE AVENUE (DWG. R /W-
5411 -L) (RESUB NO. 569)
WHEREAS, the Public Works Director for the City of
Newport Beach has recommended the vacation of a waterline
easement located on the Southeasterly Corner of Bayside Drive and
Marine Avenue and shown on Drawing No. R/W 5411 -L, a copy of
which is attached hereto and marked Exhibit "A" and incorporated
herein by reference, and legally described as follows:
The portion of that certain easement, 3.00
feet wide, as described in deed recorded in
Book 548, Page 352 of Deeds, records of Orange
County, California, lying within Parcels 1 and
2 as shown on a map filed in Book 133, Pages
14 and 15 of Miscellaneous Maps, records of
said County.
WHEREAS, for more than five years immediately
preceeding the date of this Resolution, the easement described
above has remained continuously unused by the City of Newport
Beach for any public purpose; and
WHEREAS, there are no public utility facilities in
place that would be affected by the vacation of this easement;
and
WHEREAS, no money has been expended during the five-
year period immediately preceeding the date of this Resolution,
for the maintenance of the easement; and
WHEREAS, the easement is unnecessary for present or
• perspective public use, and it is the desire of the City of
Newport Beach to summarily vacate this easement, pursuant to the
provisions of Chapter 4, Part 3, Division 9 of the Streets and
Highways Code of the State of California (Sections 8330 through
8336 of the Streets and Highways Code).
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the waterline easement described
• on Exhibit "A" attached hereto, be summarily vacated and
abandoned; and
BE IT FURTHER RESOLVED that the City Clerk shall cause
a certified copy of this Resolution, attested by the City Clerk,
under seal to be recorded in the office of the Recorder for the
County of Orange; and
BE IT FURTHER RESOLVED that from and after the date
this Resolution is recorded, the waterline easement depicted and
legally described on Exhibit "A" attached hereto, shall no longer
constitute a waterline easement.
