RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH REPEALI14G RESOLUTION NO.
11039 WHICH APPROVED GENERAL PLAN AMENDMENT
80 -3 (GPA 80 -3) AND ALLOWED RESIDENTIAL,
OFFICE, COMMERCIAL AND HOTEL DEVELOPMENT IN
NEWPORT CENTER, SUBJECT TO THE COMPLETION OF
• CERTAIN ROADWAY IMPROVEMENTS
WHEREAS, the City Council. of the City of Newport Beach
did, on August 31, 1981, duly adopt: Resolution No. 11039 approv-
ing General Plan Amendment 80 -3 (GP.A 80 -3) which authorized resi-
dential, office, commercial and hotel development in Newport
Center, subject to certain conditions, including but not limited
to, the completion of certain roadway improvements; and
WHEREAS, a referendum petition has been filed with the
City Clerk of the City of Newport Beach, signed by more than ten
percent (108) of the number of qualified, registered voters of
said City, protesting the adoption of Resolution No. 11039; and
WHEREAS, the City Clerk of the City of Newport Beach
has duly examined said referendum petition and has ascertained
that the petition is signed by a requisite number of voters and
has so certified to the City Council of the City of Newport
Beach; and
WHEREAS, the City Council the City of Newport Beach is
authorized, by virtue of the provisions of Section 4055 of the
Elections Code of the State of California, to entirely repeal
Resolution No. 11039; and
WHEREAS, an environmental impact report has been
prepared in
compliance with
the
provisions
of the California
Environmental
Quality Act, and
the
State EIR
Guidelines promul-
gated pursuant thereto, and said E:IR has been certified as com-
plete and adequate, and said EIR has evaluated a "no project"
alternative;
•NOW, THEREFORE, the City Council of the City of Newport
Beach, California does hereby RESOLVE, DECLARE, DETERMINE and
ORDER as follows:
SECTION 1. That pursuant to the provisions of Section
4055 of the Elections Code of the State of California, Resolution
No. 11039 is hereby repealed;

SECTION 2. The City Clerk of the City of Newport Beach
shall certify the passage and adoption and file same in the book
of original resolutions and shall make a minute of the passage
adopted thereof and the records of the proceedings of the City
Council of the City of Newport Beach;
SECTION 3. That this resolution shall take effect
immediately.
