A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH SUMMARILY 'VACATING AN ALLEY
EASEMENT BETWEEN 4809 RIVER AVE. AND 4802
NEPTUNE AVE. (DRG #R /W 5455 -L) AND DIRECTING
THE CITY CLERK TO RECORD SAME WITH THE COUNTY
RECORDER'S OFFICE
WHEREAS, there is a certain alley easement for ingress
and egress of vehicular traffic between 4809 River Avenue and
4802 Neptune Avenue which is more particularly set forth and
legally described at length on Exhibit "A" attached hereto and
incorporated herein by reference, and as.depicted on Drawing No.
R/W 5455 -L, attached hereto as Exhibit "B" and incorporated
herein by reference as though fully :set forth at length herein;
and
WHEREAS, the easement above- described is not being used
by the City of Newport Beach and has remained continuously unused
by the City of Newport Beach for any public purpose for a period
of five consecutive years; and
WHEREAS, no money has been expended for the maintenance
of the easement during that period of time; and
WHEREAS, there are no public utility facilities in
place that would be affected by the vacation of this easement;
and
WHEREAS, the easement is unnecessary for present or
prospective public use, and it is the desire of the City of
Newport Beach to summarily vacate this easements pursuant to the
provisions of Chapter 4 of Part 3 of Division 9 of the Streets
and Highways Code of the State of California. (Section 8333)
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Newport Beach, that the easement legally described on

above
and depicted on
the
drawing attach-
ed hereto as
Exhibit
"B ",
be
summarily vacated
and
abandoned; and
BE IT FURTHER RESOLVED, that: the City Clerk shall cause
a certified copy of this Resolution, attested by the City Clerk,
under seal, to be recorded in the office of the Recorder for the
County of Orange; and

BE IT FURTHER RESOLVED, that from and after the date
this Resolution is recorded, the easement legally described on
Exhibit "A" and depicted on Exhibit "B ", referred to above, shall
no longer be constituted public service easements.

A strip of land 15.00 feet in width over that certain parcel
of land situated in Section 29, Township 6 South, Range 10 West,
San Bernardino Meridian, according to an official plat of said land, filed
in the District-Land Office, August 4, 1890, in the City of Newport Beach,
County of Orange, State of California, the centerline of said strip of
land being described as follows:
Beginning at the most westerly corner of Lot 14, Block 48
of River Section as per map recorded in Book 4, page 25 of
Miscellaneous Maps, records of Orange County, California; /
thence northeasterly 127.00 feet along the northwesterly Tine
of said Lot 14 and its northeasterly prolongation to the
True Point of Beginning; thence southeasterly 30.00 feet
parallel to the southwesterly line of said Lot 14, to
the northeasterly prolongation of the southeasterly line
of said Lot 14.
