Home My WebLink About82-134 - Uniform Building Codes Local ConditionsRESOLUTION NO. 82 -134 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH SETTING FORTH FINDINGS WITH RESPECT TO LOCAL CONDITIONS WITHIN THE CITY • OF NEWPORT BEACH WHICH MAKE CERTAIN MODIFICATIONS AND CHANGES TO THE UNIFORM BUILDING CODE, THE UNIFORM PLUMBING CODE, AND THE'NATIONAL ELECTRICAL CODE REASONABLY NECESSARY FOR HOUSING OCCUPANCIES WHEREAS, Health & Safety Code Section 17958 mandates that the City of Newport Beach shall adopt ordinances or regulations imposing the same requirements as are contained in the regulations adopted by the State pursuant to Health & Safety Code, Section 17922; and WHEREAS, the State of California is mandated by Health & Safety Code Section 17922 to impose the same requirements as are contained in the most recent edition of the Uniform Housing Code of the International Conference of Building Officials, the Uniform.Building Code of the International Conference of Building Officials, the Uniform Plumbing Code of the International Assoc- iation of Plumbing and Mechanical Officials, the Uniform Mechanical Code of the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials and the National Electrical Code of the National Fire Protection Association (hereinafter referred to collectively as "Codes "); and WHEREAS, the 1979 Edition is the most recent edition of the Uniform Housing Code, Uniform Building Code, Uniform Plumbing Code; and .WHEREAS, the 1976 Edition Uniform Mechanical Code is the most recent edition jointly published by the International Assoc- iation of Building Officials and the International Association of Plumbing and Mechanical Officials adopted by the State Health and Safety Code; and WHEREAS, Health & Safety Code Section 17958.5 permits the City to make such changes or modifications to the Codes as are reasonably necessary because of local conditions; and WHEREAS, Health & Safety Code Section 17958.7 requires that the City Council before making 'any changes or modifications pur- suant to Section 17958.5 make express findings that such changes or modifications are needed due to climatic, geographic,or top- ographic conditions; and WHEREAS, the Building Director has recommended that changes and modification be made to the Codes and has advised that these changes and modifications model codes are reasonably necessary due to local conditions in the City of Newport Beach and has further advised that the remainder of.said changes and modifica- tions are administrative covered by the codes, or procedural in nature, or are not NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach as follows: SECTION.I The following changes and modifications to the 1979 Edition of the Uniform Building Code as recommended by the Building Director are hereby found to be necessary due to local climatic, geographical or topographical conditions: • 1. Section 1103 has been modified to permit resim. dential patios and private carports when less than 400 square feet and open on 3 sides to be governed by the Zoning Code and be constructed nearer to the property line than 3 feet. The reason for this modification is to maximize lot usage of narrow 25 ft. and 30 ft. lots and create additional off street parking -:to reduce existing_ vehicle parking shortage on public streets. 2. Section 3203(f) has been amended to require that ordinary roof covering shall have an assembly of not less than Class C roofing including built - up roofing, pressure treated wood shingles and shakes, special purpose roofs and when re- roofing. This provision should reduce the threat of serious tragedies and property loss arising from Santa Ana wind - swept.fires which occur annually in Orange County communities. 3. Chapter 35 has been amended to augment the sound transmission and noise insulation standards. This should enhance public welfare in the densely populated urban setting of Newport Beach. 4. Section 3703(f) has been amended requiring spark arresters on all chimneys. This should reduce the possibility of roof fires. 5. Section 3802(b) has been amended to require an automatic sprinkler system in all buildings having floors used for human occupancy located more than 55 feet above the lowest level of Fire Department vehicle access. This requirement matches building height with available fire- fighting equipment and human resources available in the Newport Beach Fire Department. 6. Section 5402, 04, 06,and 07 have been amended by substituting 1982 U.B.C. safety glazing require- ments for 1979 Code provisions to comply with Section 25997 of the Health & Safety Code. 7. Chapter 70 has been amended by augmenting the Code provisions of excavating and grading as well as erosion control measures to minimize siltation and pollution of the Bay and preserve the natural environment of Newport Beach. • SECTION II The following changes and modifications to the 1979 Edition of the Uniform Plumbing Code as recommended by the Building Director are hereby found to be necessary due to local climatic, geographical or topographical conditions: • 1. Section 401(a) has been amended by limiting installation of ABS and PVC drainage pipes in buildings of combustible construction only instead of any 2 -story residential construction. Fire resistive consideration are a prime criteria in a densely developed urban areas such as Newport Beach. 2. Section 503 has been amended by limiting install- ation of ABS and PVC vent piping in buildings of combustible construction only instead of any 2- story residential construction. Section 1009(h) and Table 10 -2 have been amended by requiring that water piping supply line shall be a minimum of 3/4" for any building and 1" minimum for a residence. This requirement provides more volume and thereby overcomes low water pressure conditions existing in many parts of the City. 4. Section 1310 has been modified to provide protec- tion of habitable area from drainage due to leaky water heaters by installing a pan and drain to outside or other approved receptor, The City has experienced extensive property damage from leaky heaters warranting preventive measure. 5. Appendix D 1.0(a) has been amended by limiting installation of ABS & PVC rainwater piping inside a building to areas where combustible construction is permitted, instead of any 2 -story residential construction. Fire resistive consideration are a prime criteria in a densely developed urban areas such as Newport Beach. SECTION III The following changes and modifications to the 1981 Edition of the National Electrical Code as recommended by the Building Director are hereby found to be necessary due to local climatic, geographical or topographical conditions: 1. Article 110 -5 is amended to require that only #6 AWG and larger may be aluminum. This requirement is necessitated by poor performance of the material especially in the moist and corrosive climate around the beach area. 2. Article 210 -1 is amended to require undergrounding of conductors for accessory uses or buildings located on same lot. Incidence of accidental contact by metal ladders, pool cleaning equipment or similar equipment as well as becoming discon- nected in local climatic wind storms. This article is further amended to require a race- way leading from spare circuit breakers to areas of future expansion space when provided. This requirement reduces future hazardous uninspected installations and minimizes damage of the permanent structure. 3. Article 210 -52 and 210• -70 is amended to include detached garages and carports and minimum wire sizes. This requirement provides the same degree of con- venience and safety to detached garages and carports as the code requires for attached garages. 4. Article 220 -3 is amended requiring separation of lighting circuits and receptacle circuits. This amendment provides reliability and safety in elect- rical systems by insuring that added appliances will operate properly and provides each room with 2 circuits. 5. Article 230 -43 is amended by deleting 7 of 12 methods to wire service conductors to reduce the possibility of fire and explosion by containing faults within raceway should mechanical injury of utility lines transfer high current to structure. 6. Article 230 -71 is amended requiring a single fusible switch or automatic circuit breaker. This amendment restricts the code provision of permitting 6 discon- nects jeopardizing protection of panel from overload and fire and allows for fast disconnect in time of emergency. 7. Article 250 -83 is amended to provide additional methods of grounding service panels to overcome corrosion of materials due to sulphur and acid content in local soils. 8. Article 300 -13(b) is amended to require all circuits to have continuity of conductors (pigtailing). This will prevent locally encountered failures by conductors being dependent on device connections. This will no longer permit any 'additional current to pass through the receptacle in addition to current from directly plugged -in devices. 9. Article 334 is amended by deleting the article in its entirety. Metal clad cable, commonly known as BX has not been used locally for many years due to excessive short circuits and grounding problems. Connectors and other parts are not longer stocked locally and therefore not available, forcing unsafe • substitution resulting in hazardous installations. 10. Article 336 -3 is amended by limiting the use of non - mettalic sheathed cable to one and two - family dwellings and not permit it as exposed wiring. The reason for this restriction to avoid penetration by fasteners; mechanical damage during construction, earthquake or fire; lack of protection for emergency power. • 11. Article 336 -6 is amended by deleting the article in its entirety. This non - metallic sheathed cable is easily damaged mechanically thereby creating an immediate fire and life hazard. 12. Article 348 -1 is amended by prohibiting the install- ation of metallic tubing where exposed to outside air or weather, where subject to physical damage, where galvanic action occurs due to dissimilar metals and where protected only by enamel coating. This is necessary due to local corrosive soils condition, oxidation due to salt air and weather and where during_ construction, soil compaction or concrete vibrating may cause physical damage to this thin - walled tubing. 13. Article 350 -2 is amended by prohibiting the installa- tion of flexible metal conduit where exposed to damage. Local experience shows that aluminum flexible conduit is easily damaged in areas where exposed to such poss- ibility. ' 14. Article 350 -5 is amended by prohibiting the use of flexible metal conduit as a grounding means, unless all conditions of the exception are met. Local cli- matic conditions of air and soil accelerate the corrosion of materials jeopardizing the reliability and safety of system in short order. Underwriter's Laboratories also published in May 1982, the statement that "Flexible metal conduit longer than six feet has not been judged to be suitable as a grounding means." 15. Article 410 -8 is amended by adding subsection (c) requiring the installation switches and Prohibiting pull chains in closets. This requirement reduces possibility of injuries from locating pull chain in the dark, difficult repair, use of light without pull chain functioning. 16. Article 422 -5 is amended by adding subsection (c) requiring food grinders, dish washers and washing machines, dryers, heaters and other fixed appliances with 1/3 H.P. motor or larger to be on a separate circuit. This requirement is based on local experi- ence of typical appliances installed, provides adequate circuit capacity for these larger fixed appliances and reduces costly rewiring or unsafe installation. SECTION IV Additional amendments have been made to the 1979 • Edition of the Uniform Building Code, the 1979 Edition of the Uniform Mechanical Code, the 1979 Edition of the Uniform Plumbing Code, and the 1981 Edition of the National is • Electrical Code which were found to be administrative or procedural in nature or do not concern themselves with subjects not covered in the California Adminis- trative Codes and are found to be reasonable and required to safeguard life and property within the City of Newport Beach. SECTION V A copy of this Resolution together with the Ordin- ances adopting the City Codes shall be filed with the California Department of Housing and Community Development by the City Clerk of the City of Newport Beach as required by State law.
