• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH ORDERING THE VACATION OF A PORTION OF 32ND ST.,
SOUTH OF WEST BALBOA BOULEVARD. THE VACATION TO BE
CONDITIONED UPON THE RECORDATION OF FINAL SUBDIVISION
MAP NO. 11906; SETTING FORTH CONDITIONS AND FINDINGS
THEREFOR AND DIRECTING THE CITY CLERK TO RECORD SAID
RESOLUTION UPON COMPLETION THEREOF
WHEREAS, the Public Works Director of the City of
Newport Beach has presented to the City Council of the City of
Newport Beach, a certain map, prepared by the Public Works
Department, dated z7�8s , and entitled N/A
Drawing No.R W-54 L which shows the area the City is considering
vacating; and
WHEREAS, on August 22 , 1983, the City Council of
the City of Newport Beach adopted Resolution No. 83 -85
declaring the City's intention to vacate a portion of 32nd St.,
south of West Balboa Blvd., directing the City Clerk to file same
in the proceedings for vacation, and setting September 12_1
1983 as the date for a public hearing thereon; and
WHEREAS, on September 12 , 1983, the City Council
held a public hearing for the purpose of hearing all persons
interested in or objecting to the proposed vacation of the above-
described alley; and
WHEREAS, the City Council finds and determines, from
all of the evidence submitted, that the portion of 32nd St.,
south of West Balboa Blvd., which area is more particularly
depicted on a map attached to Resolution No. 83 -93 as Exhibit
is unnecessary for present or prospective public use; and
• WHEREAS, the City Council finds:
1. An initial study has been prepared in compliance with
California Environmental Quality Act (CEQA) and the
CEQA Guidelines; and
2. A final environmental impact report has been prepared in
conjunction with the construction of 17 residential
necessary to mitigate the environmental impacts
associated with the vacation of 32nd St. to a level of
insignificant.

dwelling units to be constructed on the property which
surrounds that portion of 32nd St., to be vacated; and
• 3.
The final environmental impact report was certified as
adequate by the City Council on June 27, 1983 in
conjunction with its approval of Tentaitve Tract Map No.
11906; and
4.
The final environmental impact report fully and
adequately discusses the environmental impacts
associated with the vacation of that portion of 32nd St.
presently under consideration; and
5.
Based upon the initial study, there have been no
subsequent changes in the project analyzed in the final
environmental report that would require revisions to the
final EIR; and
6.
Based upon information contained in the initial study,
there are no new significant environmental impacts that
were not considered in the prior certified Final EIR;
and
7.
The City Council has previously adopted all measures
necessary to mitigate the environmental impacts
associated with the vacation of 32nd St. to a level of
insignificant.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the portion of the subject street
• which is more particularly depicted on City's Map NO.R/W- 5473 -L ,
a copy which is attached hereto marked Exhibit "A" be and hereby
is ORDERED VACATED AND ABANDONED.
BE IT FURTHER RESOLVED that the City Clerk of the City
Of Newport Beach be and hereby is ordered to cause a certified
copy of this resolution, attested by the Clerk under the seal of
the City of Newport Beach, to be recorded in the Office of the
County Recorder for the County of Orange, upon satisfactory
completion of the above conditions and findings by the Public
Works Department of the City of Newport Beach.
