HomeMy WebLinkAbout96-4 - General Plan Amendment 95-1A Land Use ElementRESOLUTION NO. 96-4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING AN AMENDMENT TO THE LAND USE ELEMENT OF THE NEWPORT BEACH GENERAL PLAN TO CHANGE THE LAND USE DESIGNATION AND DEVELOPMENT ALLOCATION FOR PROPERTIES LOCATED IN STATISTICAL AREAS A2 AND A3 [GENERAL PLAN AMENDMENT 95 -1 (A)] • WHEREAS, the property located at the northeast corner of the intersection of Coast Highway and Superior Avenue, commonly known as "CalTrans Residual Parcel," has limited access, steep grade, a limited development potential; and WHEREAS, given the CalTrans Residual Parcel's constraints, the Land Use Element designation of Recreational and Environmental Open Space is appropriate; and WHEREAS, in consideration for the designation of the CalTrans Residual Parcel to Recreational and Environmental Open Space, the residential development allocation for the CalTrans West property shall be increased by 8 dwelling units to a total of 160 dwelling units; and WHEREAS, should the residential development be exercised, the CalTrans Residual Parcel open space would contribute to meeting that project's park dedication requirement; and WHEREAS, on December 7, 1995, the Planning Commission of the City of Newport Beach held a public hearing regarding General Plan Amendment 95 -1 (A) and recommended approval of said amendment; and WHEREAS, on January 8, 1996, the City Council of the City of Newport Beach held a public hearing regarding General Plan Amendment 95 -1 (A); and WHEREAS, the public was duly noticed of the public hearings; and WHEREAS, pursuant to the California Environmental Quality Act, it has been determined that the proposed amendment is categorically exempt under Class 5, minor alterations in land use limitations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that an amendment to the Land Use Element of the General Plan is approved as • follows: SECTION 1. The Land Use Element Map is to be amended to redesignate the CalTrans Residual Parcel, illustrated and identified in Exhibit "A', from Governmental, Educational, and 1 Institutional Facilities to Recreational and Environmental Open Space. SECTION 2. The following paragraph shall be added to the Hoag Hospital Area (Statistical Area A3) section of the Land Use Element text: • CalTrans Residual Parcel. The parcels owned by the California State Department of Transportation and the City of Newport Beach on the easterly side of Superior Avenue created by the realignment of Superior Avenue are designated for Recreational and Environmental Open Space. This designation is in consideration for eight (8) additional units allocated to the CalTrans West site. Should the residential entitlement be exercised on the CalTrans West site, this site may be used to partially satisfy the park dedication requirements of the project. SECTION 3. The Hoag Hospital Area (Statistical Area A3) table of the Land Use Element text shall be amended as follows: SECTION 4. The Northwest Newport (Statistical Area A2) of the Land Use Element text shall be amended as follows: • CalTrans West. CalTrans West consists of approximately 14.25 acres of vacant land located west of Superior Avenue, north of Pacific Coast Highway, and south of the Newport Crest Condominium complex. 2 ESTIMATED GROWTH FOR STATISTICAL AREA A3 Residential (in do's) Commercial (in sq.ft.) The Northwest Newport (Statistical Area A2) of the Land Use Element text shall be amended as follows: • CalTrans West. CalTrans West consists of approximately 14.25 acres of vacant land located west of Superior Avenue, north of Pacific Coast Highway, and south of the Newport Crest Condominium complex. 2 The preferred future use of the site is recreation/open space with active recreational uses accommodated on the site. Specific park improvements and the possible phasing of park uses if entitlement is transferred off -site shall be consistent with the Recreation and Open Space Element. • The site is presently allocated 160 dwelling units subject to provisions intended to facilitate the transfer of all of this entitlement to other properties with special incentives relative to the transfer of entitlement to properties within the CalTrans West service area (as specified in the Recreation and Open Space Element) combined with a commitment of the owner of the transferee parcel to construct park improvements on -site. Eight (8) of these units are derived from the CalTrans Residual Parcel on the easterly side of Superior Avenue, in consideration for the designation of that site for Recreational and Environmental Open Space.
