A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF THE CITY OF NEWPORT BEACH
DECLARING ITS INTENTION TO ADOPT
RESOLUTION NO. 374 -97 -2 OF THE SOUTHERN
CALIFORNIA ASSOCIATION OF GOVERNMENTS
TO SUPPORT LEGISLATIVE INITIATIVES AND
OTHER POLICIES PERTAINING TO WASTE
DIVERSION, SOURCE REDUCTION, AND
RECYCLING
WHEREAS, the Southern California Association of Governments
(SCAG) is a Joint Powers Agency established under California Government
code Section 6502 et seq.;
• WHEREAS, SCAG is the designated Metropolitan Planning
Organization for the Counties of Imperial, Los Angeles, Orange, Riverside, San
Bernardino and Ventura, and as such is responsible for regional transportation
planning within its jurisdiction; and
WHEREAS, as the designated MPO, SCAG is required by 23 U.S.C.
§134(f)(13) to consider, inter alia, the overall social and economic effects of
transportation decisions, and is required by Federal regulations by 23 C.F.R.
§450/316(a)(13) to consider the effects and impacts of metropolitan
transportation plans on the human, natural and manmade environment such
as housing, employment and community development; and
WHEREAS, Federal regulations 23 C.F.R. §450.322(b)(9) require the
metropolitan transportation planning process engaged in by SCAG to reflect,
inter alia, national, State, and local environmental resource plans as well as
• the overall environmental goals of the Metropolitan Planning Area; and

WHEREAS, SCAG is also a designated Areawide Waste Treatment
Management Agency pursuant to 33 U.S.C. §1288, and as such is responsible
for developing effective areawide waste treatment management plans for the
area; and
WHEREAS, pursuant to Section 25135.3 of the Health and Safety
Code, SCAG is responsible, together with the San Diego Association of
Governments, for preparing the Southern California Hazardous Waste
Management Plan; and
WHEREAS, the Integrated Solid Waste Management Chapter of the
Regional Comprehensive Plan and Guide recommends eliminating unnecessary
duplication in solid waste programs carried out by local governments; and
WHEREAS, the Solid Waste Task Force promotes waste management
practices such as waste prevention, recycling, composting, safe disposal and
transformation;
NOW, THEREFORE BE IT RESOLVED that SCAG supports
retention of the AB 939 25 percent diversion mandate for year 1995; and
BE IT FURTHER RESOLVED that SCAG supports changes to AB
939 that would makes the 50 percent diversion mandate for year 2000 a goal
and extends the 50 percent diversion mandate to year 2010; and
BE IT FURTHER RESOLVED that SCAG supports initiating State
legislation establishing 1990 or 1995 data as the base year for the balance of
AB 939 waste diversion targets and gives credit to cities and counties that
have met or exceeded their year 1995 25 percent diversion mandate; and
BE IT FURTHER RESOLVED that cities and counties should have
the option to use 1990 or 1995 as the base year; and

• BE IT FURTHER RESOLVED that the subsequent target should be
credited by anything not sent to the landfill as residual solid waste; and

BE IT FURTHER RESOLVED that any waste that is transformed or
composted should not be considered as residual solid waste; and
BE IT FURTHER RESOLVED that SCAG encourages cities and
counties to continue implementing their Source Reduction and Recycling
Elements; and
BE IT FURTHER RESOLVED that the Regional Council of the
Southern California Association of Government supports above revised Solid
Waste Management Policies and encourages its local jurisdictions to do the
same; and

City Council of said City at a regular meeting of said Council, duly and regularly held on the 27th
day of May, 1997, and that the same was so passed and adopted by the following vote, to wit:
