HomeMy WebLinkAbout84-49 - Fair Share FeesRESOLUTION NO. 54 -49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING A SYSTEM REQUIRING THE PAYMENT OF FAIR SHARE FEES TO IMPLEMENT THE CITY'S MASTER PLAN OF STREETS AND HIGHWAYS (EXCLUDING UNIVERSITY DRIVE) WHEREAS, the City of Newport Beach General Plan and Zoning Code • establish limits for the ultimate buildout of the City; and WHEREAS, the City's Master Plan of Streets and Highways (excluding University Drive) is designed to accommodate the anticipated levels of development permitted by the General Plan and Zoning Code; and WHEREAS, the City's adopted Local Coastal Program Land Use Plan, contains a Program Plan of Streets and Highways; and WHEREAS, the State Coastal Commission, in certifying the City's Adopted Local Coastal Program Land Use Plan, deleted University Drive from the Program Plan of Streets and Highways; and WHEREAS, implementation of the Master Plan of Streets and Highways (excluding University Drive) must coincide with the new development anticipated; and WHEREAS, the City has identified the specific improvements and the estimated total costs to implement the Master Plan of Streets and Highways (excluding University Drive); and WHEREAS, the City has identified potential funding sources for a portion of the improvements necessary to implement the Master Plan of Streets and Highways (excluding University Drive); and WHEREAS, the City's ability to fund the balance of these improvements has been restricted by State legislation limiting the ability of local governments to impose new taxes; and WHEREAS, a shortfall exists between the total costs of the required circulation system improvements to implement: the City's Master Plan of Streets and Highways (excluding University Drive) and the funds that are currently anticipated; and WHEREAS, the Newport Beach City Council has determined that the balance of necessary funds to implement the Master Plan of Streets and Highways (excluding University Drive) should be borne by future development; and WHEREAS, the Newport Beach City Council has developed an equitable system of allocating the unfunded costs to implement the Master Plan of Streets and Highways (excluding University Drive) to new development; NOW, THEREFORE, the City Council of the City of Newport Beach does hereby resolve as follows: That the total net roadway cost to implement the City's Master Plan of Streets and Highways (excluding University Drive) is $15.3 Million as set forth in the attached Exhibit "A ". • That the total anticipated vehicle trips resulting from the trend growth of all land use categories is 180,314 trips, as set forth in the attached Exhibit "B ". The total contribution by land use category is as follows: Residential: (per unit) Single Family Detached $1.103.05 per d.u. Single Family Attached, Duplex, Triplex, Fourplex $ 721.23 per d.u. Fiveplex, or Greater $ 551.53 per d.u. Hotels /Motels: (per room) $848.50 per room Commercial: Regional $ 3.82 per sq.ft. (net floor area) General Retail (gross floor area) $ 3.39 per sq.ft. Boat Yards (net floor area) $ 3.39 per sq.ft. Office: General (net floor area) $ 1.10 per sq.ft. Medical (gross floor area) $ 3.39 per sq.ft. Restaurant: (gross floor area) Conventional $ 6.36 per sq.ft. Take Outs $ 3.39 per sq.ft. Industrial: (net floor area) $ 0.51 per sq.ft. Recreational: (net floor area) Yacht Clubs $ 4.24 per sq.ft. Athletic Clubs $ 3.39 per sq.ft.
