RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH SUMMARILY VACATING A PUBLIC
UTILITY EASEMENT ON VISTA CAJON (TRACT 5480)
WHEREAS, the Public Works Director for the City of
Newport Beach has r
wide public utility
the intersection of
5480 as depicted on
incorporated herein
follows:
ecommended the vacation of an unused 10 foot
easement, located on Vista Cajon, easterly of
Vista Cajon and Carlotta Street, in Tract
a drawing attached hereto as Exhibit "A," and
by reference which is legally described as
That certain public utility easement, 10.00
feet wide, as shown on a map of Tract No. 5480
filed in Book 196, pages 35, 36 and 37 of
Miscellaneous Maps, Records of Orange County,
California, the centerline of said easement
having the bearing and length of N 40032 "54" E
66.11 feet is parallel with and 10.00 feet
northwesterly from the northwesterly line of
Lot 4 "G" of said tract.
WHEREAS, for more than five years immediately
preceeding the date of this Resolution, the easement described
above has remained continuously unused by the City of Newport
Beach for any public purpose; and
WHEREAS, there are no public utility facilities in
place that would be affected by the vacation of this easement;
and
WHEREAS, no money for the maintenance of the easement
has been expended during the five—year period immediately
preceeding the date of this Resolution; and
WHEREAS, the easement is unnecessary for present or
prospective public use, and the City desires to summarily vacate
this easement pursuant to the provisions of Chapter 4, Part 3,
Division 9 of the Streets & Highways Code of the State of
California (Sections 8330 through 8336 of the Streets and
Highways Code).
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the public utilities easement as
depicted on Exhibit "A" attached hereto, be summarily vacated and
abandoned; and
BE IT FURTHER RESOLVED that the City Clerk shall cause
a certified copy of this Resolution, attested under seal to be
recorded in the office of the Recorder for the County of Orange;
and
BE IT FURTHER RESOLVED that from and after the date
this Resolution is recorded, the public utilities easement
depicted on Exhibit "A" hereto, shall no longer constitute a
public utilities easement.
