A RESOLUTION OF THE CITY COU19CIL OF THE CITY
OF NEWPORT BEACH DECLARING CITY'S INTENTION TO
VACATE A PORTION OF A WATERLINE EASEMENT
LOCATED SOUTHERLY OF THE INTERSECTION OF SAN
JOAQUIN HILLS ROAD; ACCEPTING A MAP SHOWING
THE PORTION PROPOSED TO BE VACATED; AND
• SETTING JANUARY 14, 1985 AS THE DATE FOR A
PUBLIC HEARING CONCERNING THE INTENDED
VACATION (DRAWING NO. R /W- 5491 -L)
WHEREAS, the provisions of the Street Vacation Act and
all amendments thereto, being Sections; 8300 to 8325 and 8340 to
8353 inclusive, of the Streets and Highways Code of the State of
California, provide for the vacation of easements; and
WHEREAS, on August 4, 1983, the Planning Commission of
the City of Newport Beach conditionally approved Resubdivision
752 which was also reviewed and approved on September 12, 1983 by
the City Council of the City of Newport Beach; and
WHEREAS, in obtaining approval of Resubdivision 752,
the Four Seasons Hotel (developer) desired to relocate a portion
of a waterline easement to accommodate its own development on the
real property; and
WHEREAS, as a condition of approval of Resubdivision
752, the Four Seasons Hotel agreed to relocate a portion of the
City's existing water facilities located within the subject
easement at its own expense; and
WHEREAS, the area to be vacated is legally described on
Exhibit "A" hereto and depicted on a map attached as Exhibit "B ",
both incorporated herein by reference ;, and
WHEREAS, proceedings for the vacation of the above-
described easement shall be undertaken by the City of Newport
Beach pursuant to the provisions of the Street Vacation Act of
1941 and all amendments thereto, being Sections 8300 and 8325 and
• 8340 to 8353 inclusive of the Streets and Highways Code of the
State of California.,
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that notice is hereby given and that
the City Council does hereby fix January 14, 1985 at the hour of
• 7:30 p.m. of said day, in the City Council Chambers of the City
of Newport Beach, located at 3300 Newport Boulevard, Newport
Beach, California, as the time and place for hearing all persons
intersted in or objecting to the proposed vacation of said
easement, and the City Council at said time and place will hear
the evidence offered by any person interested in the vacation of
said easement herein described.
BE IT FURTHER RESOLVED that this Resolution of
Intention shall be published at least once in the official
newspaper of the City and said publication shall be made before
the date set for the hearing of all persons interested in or
objecting to the proposed vacation.

Those portions of Lot 22, Tract No. 6015 as per map filed in Book 239,
Pages 28 to 41 inclusive, of Miscellaneous Maps, records of said Orange
County, described as follows:
Parcel 1
A strip of land, 24.00 feet in width, lying southwesterly, southeasterly
and southerly of and adjoining the following described line:
Commencing at a point on the northwesterly line of that certain land
described in the easement to the City of Newport Beach recorded June 14,
1971 in Book 9675, Page 396 of Official Records, distant North 50° 45' 00"
East 48.00 feet from the southwesterly terminus of that certain course
described as "thence South 500 45' 00" West 236.10 feet" in said easement;
thence North 39° 15' 00" West 310.67 feet to the True Point of Beginning;
thence South 500 45'. 00" West 218.65 feet to the beginning of a curve
concave northerly having a radius of 144.00 feet; thence southwesterly
26.20 feet along said curve through an angle of 10° 25' 29" to a point
hereinafter referred to as Point "A ", a radial to said point bears
South 28° 49' 32" East; thence westerly 99.17 feet continuing along said
curve through an angle of 39° 27' 30 "; thence North 79° 22' 01" West
63.95 feet to the westerly line of said Lot 22.
EXCEPT the southeasterly 5.00 feet of the northeasterly 24.00 feet of said strip of land.
The southerly line of said strip of land shall be shortened so as to
terminate in said westerly line of Lot 22.
Parcel 2
A strip of land; 5.00 feet in width, the center line of which being de-
scribed as follows:
Beginning at Point "A" as described in Parcel 1 above; thence South
28° 49' 32" East 29.00 feet.
EXCEPT that portion thereof lying within said parcel.
Said easement is shown on a drawing, a copy of which is for the sake of con-
venient identification, marked Exhibit 'B" and attached hereto and made a part hereof
