Special Meeting
January 13, 2014 — 5:30 p.m.
I. ROLL CALL - 5:30 p.m.
Present: Council Member Gardner, Council Member Petros, Mayor Pro Tem Seiich, Mayor Hill, Council
Member Curry, Council Member Henn, Council Member Daigle
IL PUBLIC COMMENTS
Jim Mosher questioned if the City is starting a new pattern of holding a Special Meeting prior to the first
Regular Meeting of the year to conduct Closed Sessions. He suggested posting a list of all litigations the
City is currently involved in on the internet.
City Attorney Harp announced that the City Council will be meeting in Closed Session to discuss the items
listed on the Closed Session Agenda and listed the agenda items. He reported that Council Member Henn
will be recusing himself on Item III.B. (Initiation of Litigation) due to a potential conflict of interest based
on a business interest.

Employee Organizations: All Labor Associations: Association of Newport Beach Ocean
Lifeguards (ANBOL); Newport Beach City Employees Association (NBCEA); Newport Beach
Employees League (LABEL); Newport Beach Firefighters Association (NBFA); Newport Beach
Fire Management Association (NBFMA); Lifeguard Management Association (NBLMA);
Newport Beach Police Association (NBPA); Newport Beach Police Management Association

IV. CLOSED SESSION REPORT
City Attorney Harp reported that Mayor Pro Tern Selich recused himself from Item III.A.7 (Newport Beach.
Dockowners Association, et al. u. City of Newport Beach, et al.) because he owns a private pier.
City Attorney Harp also announced that the City Council authorized the City Attorney's Office to initiate
litigation to resolve a claim by Lido Partners that it has an easement across the property located at 3300
Newport Boulevard. Council. Member Henn recused himself from this matter because he, has a potential
conflict of interest based on a business relationship with Via Lido Drugs which is located in Via Lido
Plaza. All of the remaining Council Members were present and voted in favor of initiating litigation. The
action, defendants, and the other particulars shall be disclosed to any person upon inquiry once litigation
is commenced.
V. ADJOURNMENT - 6:05 p.m.
The agenda for the Special Meeting was posted on January 9, 2014, at 4:00 p.m. on the City's
website; on January 9, 2014, at 4:00 p.m. on the City Hall Electronic Bulletin Board located in
the entrance of the City Council Chambers at 100 Civic Center Drive; and on January 9, 2014,
at 4:00 p.m. in the Meeting Agenda Binder located in the entrance of the City Council
Chambers at 100 Civic Center Drive.
