A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH EXPANDING THE
RESPONSIBILITIES OF THE BUILDING CODE BOARD OF
APPEALS TO INCLUDE ACTING AS THE
REHABILITATION COMMISSION UNDER NEWPORT BEACH
MUNICIPAL CODE SECTION 15.28.090
WHEREAS, the Building Code Board of Appeals has been an
existing Commission since 1962;
WHEREAS, Newport Beach Municipal Code Section 15.28.090
provides that the City Council may appoint a Rehabilitation
Commission consisting of five (5) qualified electolrs of the City
who are competent by reason of their experience add training to
pass upon matters relating to the rehabilitation Ind demolition
of substandard buildings;
WHEREAS, the members of the Building Code Board of
Appeals are competent by reason of their experience and training
to pass upon matters relating to the rehabilitation and
demolition of substandard buildings; and
WHEREAS, the City Council wishes to expand the duties
of the Building Code Board of Appeals to include acting as a
Rehabilitation Commission and conducting hearings on abatement of
substandard buildings in accordance with Chapter 115.28 of the
Newport Beach Municipal Code.
NOW, THEREFORE, be it resolved by the City Council of
the City of Newport Beach that the following be added to the
responsibilities of the Building Code Board of Appeals:
C. Five (5) members of the Building Code
Board of Appeals shall act as the i
Rehabilitation Commission and conduct
hearings on abatement of substandard
buildings in accordance with Chapter
15.28 of the Newport Beach Municipal
Code. The Secretary to the Building Code
Board of Appeals shall select the five
(5) Rehabilitation Commissioners from the
• seven (7) members of the Building Code
Board of Appeals on a rotating basis.
