A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH CALLING AND GIVING NOTICE OF
A SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE
CITY OF NEWPORT BEACH ON TUESDAY, NOVEMBER 3,
• 1987, FOR THE SUBMISSION TO THE QUALIFIED
ELECTORS OF SAID CITY A MEASURE RELATING TO
THE LEASING OF RESIDENTIALLY - DEVELOPED PARCELS
IN THE AREA KNOWN AS BEACON BAY.
WHEREAS, the City Council of the City of Newport Beach
desires to submit to the qualified electors of said City, at a
special election, a measure authorizing the Council to lease, for
a term of 50 years, parcels currently developed as single - family
residences and located in an area known as Beacon Bay;
WHEREAS, the vast majority of parcels within Beacon Bay
are currently subject to an agreement to lease which converts to
a ground lease December 31, 1987 and continues to January 1,
2006;
WHEREAS, the Newport Beach City Charter requires voter
approval of all contracts and leases for a term longer than 25
years;
NOW, THEREFORE, the City Council of the City of Newport
Beach, California does hereby resolve, declare, determine and
order as follows:
1. Pursuant to the Charter of the City of Newport
Beach and the Constitution and the laws of the State of
California, a special election is hereby called and ordered to be
held in the City of Newport Beach, County of Orange, State of
California on Tuesday, November 3, 1987, for the purpose of
submitting the following question to the qualified electors of
the City:
SHALL THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH BE AUTHORIZED TO
ENTER INTO LEASES HAVING A TERM NOT
• TO EXCEED FIFTY (50) YEARS AND A
RETURN TO THE CITY BASED ON FAIR
MARKET RENT WITH PERIODIC ADJUST-
MENTS OF RESIDENTIALLY - DEVELOPED
PROPERTIES IN BEACON BAY.

2. That the polls for said election shall be opened
and remain open and close to coincide with the polls for the
statewide election to be held on the! same day.
3. That an "X" placed in the voting square after the
word "Yes" in the manner hereinbefore provided shall be counted.
in favor of the adoption of the proposition; an "X" placed in the
voting square after the word "No" in the manner hereinbefore
provided shall be counted against the adoption of the
proposition.
4. That notice of the time and place of .holding said
election is hereby given and the City Clerk is hereby authorized,
instructed and directed to give such further or additional notice
of said election in the time, form and manner as is required by
law, and that in all particulars not recited in this resolution,
said election shall be conducted and conducted as provided by law
for holding municipal elections in said City.
5. That the City Clerk shall certify to the passage
and adoption of this resolution, shall enter the same in the book
of original resolutions of said City, and shall make a minute of
the passage and adoption thereof in the records of the
proceedings of the City Council of said City, in the minutes of
the meeting at which the same is passed and adopted.
6. That this resolution shall take effect immediately.
