A RESOLUTION OF THE CITY COUNCIL OF THE
THE CITY OF NEWPORT BEACH DECLARING THE
CITY'S VACATION OF SPYGLASS HILL ROAD
ADJACENT TO 3841 OCEAN BIRCH DRIVE
WHEREAS, the City Council of the City of Newport Beach, pursuant to
the provisions of the Street Vacation Act (Section 8300 et seq. of the Streets &
Highways Code) is authorized to vacate public use; and
WHEREAS, the City Council of the City of Newport Beach has reviewed
and considered the various elements of the General Plan of the City of Newport
Beach prior to declaring its intent to vacate this portion of Spyglass Hill
Road and has determined that the proposed vacation is consistent with the
General Plan.
WHEREAS, the City Council of the City of Newport Beach held a public
hearing on the proposed street vacation legally described on Exhibit "A" and
depicted on the Map attached as Exhibit "B" at 7:30 p.m. on November 14, 1988,
in the Chambers of the City Council of the City of Newport Beach located at 3300
Newport Boulevard, Newport Beach, California; and
WHEREAS, the City Council of the City of Newport Beach desires to
vacate the street vacation depicted on the map attached as Exhibit "B" and
legally described on Exhibit "A ", the vacation to be processed pursuant to the
provisions of the Street Vacation Act.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Newport Beach that the street vacation depicted on the map attached as Exhibit
"B ", and legally described on Exhibit "A" is hereby ordered vacated and
abandoned.
BE IT FURTHER RESOLVED, that the City Clerk is hereby directed to have
this Resolution recorded by the Orange County Recorder.
DESCRIPTION
— That - particular parcel of land located in the city of Newport Beach,
County of Orange, State of California, described as follows:
Beginning at the southeast corner of Spyglass Will Road as shown on
Tract Map No. 7247 recorded in book. 278, pages 21 through 25 of
Miscellaneous Maps on file in the office of the County Recorder in
Orange County; thence S 88" 57' 00" W 84.00 feet to the beginning of
non tangent curve, concave southwesterly having a radius of 25.00
feet; thence northwesterly along said curve an arc distance of 40.12
feet through a central angle of 91" 57' 30" to the southerly line of
Ocean Birch Drive as shown on said map; thence N 86" 59' 30" E 109.92
feet along the easterly prolongation of said southerly line of Ocean
Birch Drive (to the easterly lineof Spyglass Hill Road) to the point
of beginning. -
