HomeMy WebLinkAbout89-95 - General Plan Amendment 89-1E Land Use ElementRESOLUTION NO. 89 -95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH APPROVING AN AMENDMENT TO THE LAND USE ELEMENT OF THE NEWPORT BEACH GENERAL PLAN FOR THE AGATE AVENUE COMMERCIAL AREA ON BALBOA ISLAND [GENERAL PLAN AMENDMENT 89 -1 (E)] WHEREAS, as part of the development and implementation of the Newport Beach General Plan the Land Use Element has been prepared; and WHEREAS, said element of the General Plan sets forth objectives, supporting policies and limitations for development in the City of Newport Beach; and WHEREAS, said element of the General Plan designates the general distribution and general location and extent of the uses of land and building intensities in a number of ways, including residential land use categories and population projections, commercial floor area limitations, the floor area ratio ordinances; and WHEREAS, the Land Use and Circulation Elements are correlated as required by California planning law; and WHEREAS, the provisions and policies of the Land Use and Circulation Elements are further implemented by the traffic analysis procedures of the Traffic Phasing Ordinance and the implementation programs of that Ordinance and the Fair Share Traffic Contribution Fee Ordinance; and WHEREAS, pursuant to Section 707 of the Charter of the City of Newport Beach, the Planning Commission has held a public hearing to consider a certain amendment to the Land Use Element of the Newport Beach General Plan; and WHEREAS, the proposed project is compatible with the existing land uses on Agate Avenue on Balboa Island; and WHEREAS, the circulation system will not be significantly impacted by the proposed project; and • WHEREAS, the City of Newport Beach prepared a Negative Declaration with supporting Initial Study for the project in compliance with the California Environ- mental Quality Act (CEQA) and the State CEQA Guidelines; and WHEREAS, the City Council has reviewed and considered the information contained in the environmental document in making its decision on the proposed amendment to the Land Use Element of the Newport Beach General Plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that an amendment to the General Plan with related provisions and requirements as described below is approved. Page 17, Paragraph 2: These major land use categories are broken down into sub - categories, and further described. The uses described in these land use categories should be considered as predominant, proposed uses and additional land uses may be established for specific areas of the City. Each area of the City is described in the land use plan, an appropriate land use designation specified as well as any additional specific land uses and a density or intensity of development established. Within these assigned intensities of development, transfers of development rights or clustering of development to result in more efficient use of land or increased visual open space may be permitted, subject to the specific provisions of the Newport Beach Municipal Code. In approving a transfer of development rights, a finding must be made that the building scale and intensity between the sites involved in the transfer result in a net benefit to the esthetics of the area." Page 38: Agate Avenue. The commercial area on Agate Avenue is allowed a maximum floor area ratio of 0.5011.0. Separate residential uses are prohibited, and automobile and general storage is permitted in addition to those uses allowed in areas designated for Retail and Service Commercial. Residential development on the second floor is permitted in conjunction with ground floor commercial up to a total floor area ratio of 1.25. One dwelling unit is allowed for each 2,000 sq.13. of buildable lot area, with a minimum of one dwelling unit allowed per lot." ADOPTED this 14th day of AueusL, 1989.
