A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
SUMMARILY VACATING AND ABANDONING A PORTION OF
STORM DRAIN EASEMENT LOCATED IN LOT 1, TRACT NO. 1218 (800 15TH
STREET) ON THE CORNER OF 15TH STREET AND ST. JAMES ROAD IN THE
CLIFFHAVEN AREA
WHEREAS, the City Council of the City of Newport Beach,
pursuant to the provisions of the Street Vacation Act (Section 8330
et sea. of the Streets & Highways Code) is authorized to summarily
• vacate public easements; and
WHEREAS, there is a certain portion of a storm drain
public easement located in Lot 1, Tract No. 1218 (800 15th Street)
on the corner of 15th Street and St. James Road in the Cliffhaven
area which is legally described in Exhibit "A" attached hereto and
incorporated herein by reference, and depicted on Exhibit "B" and
incorporated herein by reference as though fully set forth at
length herein; and
WHEREAS, the easement above - described is not being used
by the City of Newport Beach for the purpose for which it was
dedicated or acquired and has remained continuously unused by the
City of Newport Beach for any public purpose for a period of five
consecutive years; and
WHEREAS, no money has been expended for the maintenance
of the easement during that period of time; and
WHEREAS, there are no public facilities in place that
would be affected by the vacation of this easement; and
WHEREAS, the City Council of the City of Newport Beach
has reviewed and considered the various elements of the General
Plan of the City of Newport Beach prior to declaring a summary
vacation of easement and has determined that the proposed vacation
is consistent with the General Plan.
WHEREAS, the easement is un- necessary for present or
prospective public use, and it is the desire of the City Council of
the City of Newport Beach to vacate the easement legally described
in Exhibit "A" and depicted on Exhibit "B ", the vacation to be
processed pursuant to the provisions of the Street Vacation Act.
NOW, THEREFORE, be it resolved by the City Council of the
City of Newport Beach that the easement legally described in
Exhibit "A ", and depicted on the map attached as Exhibit "B" is
hereby ordered to be summarily vacated and abandoned, from and
after the date of recordation of this resolution.
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to have this resolution recorded by the Orange County
• Recorder.

Beach, State of California, per map filed in Book 37, Pages 47,48
and 49 of Miscellaneous Maps, in the office of the County Recorder
of said County, said portion being described as follows:
Commencing at the most northerly corner of said Lot 1; thence
along the northeasterly line of said lot S 37 011100" E 19.87 feet
to the True Point of Beginning, said True Point of Beginning being
a non - tangent curve concave southeasterly and having a radius of
280.00 feet, said curve being concentric with and 20.00 feet south -
easterly, measured radially, from the northwesterly line of said
lot; thence southwesterly along said curve, through a central angle
of 7 03510811, an arc length of 37.07 feet to a tangent line parallel
with and 20.00 feet southeasterly, measured at right angles, from
said northwesterly line; thence along said parallel line
S 39 042110" W 53.92 feet; thence N 5 036156" 14.06 feet to a line
parallel with and 10.00 feet southeasterly, measured at right
angles, from said northwesterly line; thence along said last
mentioned parallel line N 39 °42110" E to the beginning of a tangent
curve concave southeasterly and having a radius of 290.00 feet;
thence northeasterly along said last mentioned curve, through a
central angle of 7 04612011, an arc length of 39.34 feet to said
northeasterly line of said Lot 1; thence southeasterly in a direct
line to the True Point of Beginning.
