ESTABLISHING
AREAS MAY BE
NO. 89 -10.
WHEREAS, Sections
OF THE CITY COUNCIL OF THE CITY
EACH DESIGNATING SURFING AREAS,
DATES AND HOURS WHEN SURFING
USED, AND RESCINDING RESOLUTION
11.16.020, 11.16.030, and 11.16.040 of the
Newport Beach Municipal Code authorize the City Council to
designate certain areas of the Pacific Ocean where surfing is
permitted or prohibited, specify the dates and hours when such
areas may be used for surfing, regulate the use of surfing areas by
swimmers, and adopt other regulations relating to surfing; and
WHEREAS, the City Council has adopted Resolution No. 89 -10
designating surfing areas and establishing certain dates and hours
when such areas may be used for surfing; and
WHEREAS, the City Council finds that the "Wedge" is an area
particularly suited to bodysurfing and that floatation devices such
as surfboards pose a danger to bodysurfers at the Wedge; and
WHEREAS, the City Council wishes to rescind Resolution No. 89-
10 and substitute the following regulations.
NOW, THEREFORE, be it resolved by the City Council of the City
of Newport Beach that the following board surfing regulations are
hereby established:
section I. Surfing Areas Designated. The following
described areas of the Pacific Ocean are hereby designated as board
surfing areas:
(A) Surfing Area No. 1 The area between the westerly
boundary of the City of Newport Beach and the West Harbor Jetty,
exclusive of the area between a prolongation of 40th Street and a
prolongation of 44th Street. Board surfing is prohibited between
40th Street and 44th Street from May 1st through and including
October 31st.
• (B) Surfing Area No. 2 The area beginning 20 feet
easterly of the East Harbor jetty and extending to a point 200 feet
from the East Harbor jetty.
(C) Surfing Area No. 3 The area commonly known as
Little Corona Beach.

Section 2. Dates Surfing Permitted. Effective June 15th
through September 10th, and subject to the limitations in Sections
3, 4 and 6, as well as other ordinances and regulations, surfing
shall be permitted in all areas designated in Section 1. After
September 10th and before June 15th, surfing is permitted at all
• ocean beaches subject to the limitations in Sections 4 and 6 and
other applicable ordinances or regulations.
Section 3. Hours Surfing Permitted. From June 15th through
September 10th, surfing shall be permitted in Areas 1, 2, and 3
only between the hours of 6:00 a. m. and 12:00 Noon and between 4:00
p.m. and sunset, subject to the limitations in Sections 4 and 6 and
other applicable ordinances or regulations.
Section 4. Blackball Flag. The Blackball Flag is any
flag or sign with a yellow background with a large black circle in
the center. When the Blackball Flag is displayed in any area,
regardless of the date or time, surfing is prohibited.
Section 5. Swimming in Surfing Areas. Swimming is
permitted during surfing hours in all surfing areas except Surfing
Area No. 2 where no swimming is allowed during surfing hours.
Section 6. Flotation Devices at the Wedge. All
flotation devices such as surf boards, boogie boards, and body
boards, etc. are prohibited at the area commonly known as the
"Wedge ", described as the area from the West Jetty westerly 440
yards to lifeguard tower "P", from May 1st through October 31st,
between the hours of 10:00 a.m. and 5:00 p.m.
BE IT FURTHER RESOLVED that Resolution No. 89 -10 is hereby
rescinded.
