A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING THE ANNEXATION OF
UNINHABITED TERRITORY CONTIGUOUS TO THE CITY OF
NEWPORT BEACH, COUNTY OF ORANGE, KNOWN AND
DESIGNATED AS THE ANNEXATION OF TENTATIVE TRACT 14795 -
SEAWARD 17 (ANNEXATION NO. 92)
• WHEREAS, a group of property owners collectively known as Seaward 17, Inc. has
acquired a 1.22 -acre uninhabited parcel of land known as Tentative Tract 14795 - Seaward
17, which is located within the unincorporated territory of the County of Orange and
immediately adjacent to the City of Newport Beach; and
WHEREAS, it is the desire of the Seaward 17 property owners that the
unincorporated territory known as Tentative Tract 14795 - Seaward 17 be annexed to the
City of Newport Beach; and
WHEREAS, on March 1, 1993 a Landowner Petition requesting approval of the
proposed annexation to the City of Newport Beach was submitted to the Local Agency
Formation Commission of Orange County ( "LAFCO ") by the owners of the property; and
WHEREAS, on March 22, 1993 the City Council of the City of Newport Beach
adopted Resolution No. 93 -12 requesting LAFCO approval of the proposed annexation
subject to the terms of the Master Property Tax Transfer Agreement for undeveloped
property; and
WHEREAS, on April 27, 1993 the Orange County Board of Supervisors adopted
Resolution No. 93 -434 approving the reallocation of property tax revenues from the
proposed annexation in accordance with the terms of the Master Property Tax Transfer
Agreement, with said property deemed to be undeveloped; and
WHEREAS, on May 14, 1993 LAFCO issued a Certificate of Filing and set a hearing
date of July 14, 1993 for consideration of the subject annexation; and
WHEREAS, on July 14, 1993, LAFCO, with the unanimous consent of all
landowners, adopted Resolution No. 93 -11 approving the annexation of the uninhabited
territory known as the Annexation of Tentative Tract 14795- Seaward 17 to the City of
Newport Beach; and
WHEREAS, pursuant to Resolution No. 93 -11 LAFCO has designated the City
Council of the City of Newport Beach as the Conducting Authority and has authorized the
City Council to annex the subject territory without notice and hearing and without election
as provided by Section 56837 of the Government Code; and
WHEREAS, the City Council has reviewed and considered the findings and orders
contained in LAFCO Resolution No. 93 -11 regarding this annexation; and
WHEREAS, pursuant to the requirements of the California Environmental Quality
Act a Negative Declaration has been prepared and adopted by LAFCO in its capacity as
Lead Agency for the subject annexation. The Negative Declaration finds that there is no
• substantial evidence that this action may have a significant effect on the environment.
NOW, THEREFORE, BE IT RESOLVED that:
1. The City Council of the City of Newport Beach, in its capacity as a
Responsible Agency under CEQA, has reviewed and considered the potential
environmental effects of the proposed project as described in the Negative

Declaration prior to making a decision to approve the project. The City
Council finds that there is no substantial evidence that the project may have
a significant effect on the environment, and therefore no mitigation measures
are required. The City Council has exercised its independent judgement in
reviewing the project's potential environmental effects and in deciding to
approve the project.
2. The City Council hereby approves the annexation to the City of Newport
Beach, County of Orange, State of California of that certain uninhabited
territory known as Tentative Tract 14795 - Seaward 17, more particularly
described in the legal description attached hereto as "Exhibit A" and further
depicted in the map attached hereto as "Exhibit B ", both incorporated herein
by reference.
3. The official boundary of the City of Newport Beach, County of Orange, State
of California is hereby altered to include the above - described territory.
4. Seaward Seventeen, Inc., as applicant, shall be liable and pay the applicable
State Board of Equalization filing and processing fee prior to the issuance of
the final statement of boundary change by the Executive Officer of the Local
Agency Formation Commission.
The regular county assessment role shall be utilized for the purposes of this
annexation.
6. There is no existing general bonded indebtedness of the City of Newport
Beach affecting the territory that is the subject of this annexation.
7. These proceedings are undertaken pursuant to the Cortese -Knox Local
Government Reorganization Act of 1985 (California Government Code Sec.
56000 et seq.)

Parcel 1 of Parcel Map No. 89 -137, as shown on a map filed in

Book 272, Paces 39 to 41 inclusive of Parcel Maps, records of

said Orange County, more particularly described as follows;

BEGINNING at an angle point in the existing boundary

line of the City of Newport Beach as established by the "Corona

Highlands Annexation ". certified by the Secretary of State on
13
January 12. 1949, said point of beginning also being the
14
Southeasterly terminus of that certain course described as
15
"South 25'42'20" East, 239.20 feet" in said annexation, said
16
angle point also being the most Easterly corner of Lot 181 as
17
shown on a map of Tract No. 1237 recorded in Book 40, Pages '19
18
and 20 of Miscellaneous Maps, records of said Orange County;

Thence along said existing City boundary line as

established by said "Corona Highlands Annexation" in a general
21
Northwesterly and Northeasterly direction to an angle point in
22
said City boundary line, being the Southeasterly terminus of that
23
certain course\described as "South 65 °12' East, 301.93 feet" in
24
said annexation, said angle point also being the Northeasterly
25
corner of Lot 164 of said Tract No. 1237;

Thence leaving said existing City boundary as

established by "Corona Highlands Annexation" and following the

boundary of said Parcel 1 of Parcel Map No. 89 -137 through the
