A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH REGARDING DESTRUCTION OF
FIRE
RECORDS
WHEREAS, The Newport Beach Fire Department has asked for
• approval to destroy certain of the records it now maintains; and
WHEREAS, California Government Code §34090 requires that all
City records be maintained for a minimum of two years unless
otherwise required by statute; and
WHEREAS, Prior to destroying any City record, the City Council
must approve, and the City Attorney must consent to, the
destruction; and
WHEREAS, Any record may be destroyed if it is first
microfilmed and made accessible for public use (Government Code
§34090.5).
NOW, THEREFORE, the City Council of the City of Newport Beach
resolves that the Newport Beach Fire Department may destroy the
following records after the specified retention period:
1. Hazardous Materials' Questionnaires submitted with
applications for development or building permits pursuant
to Government Code §65850.2, the historical card index
system referencing every fire incident in Newport Beach,
and Certificates of Occupancy which are duplicates of
those required to be maintained by the Newport Beach
Building Department need not be retained by the Newport
Beach Fire Department and may be destroyed immediately;
2. Plans and permits for the installation of special systems
such as fire alarms, fire sprinklers and underground
• tanks may be microfilmed. The microfilm shall be
maintained by the Newport Beach Building Department
pursuant to Government Code §34090.5 and the original
plans and permits destroyed one year after the
installation is finalled.
3. Records, correspondence, and reports of fire
investigations shall be retained for three years.
4. Records and correspondence regarding inspections, and
fire safety violations shall be maintained for two years.
5. Records and correspondence regarding Risk Management
• Prevention Programs shall be maintained until one year
after the subject of the record ceases business in
Newport Beach.
