TITLE: Adopt Resolution Removing Existing Two -hour Parking Restrictions on West
16th Street from Babcock Street to Placentia Avenue
ABSTRACT:
In an effort to improve the overall parking conditions on West 16th Street, staff recommends
adopting a Resolution to Remove Existing Two (2) hour Parking Restriction on West 16th
Street from Babcock Street to Placentia Avenue.
RECOMMENDATION:
a) Rescind Resolution No. 2009 -62; and
b) Adopt Resolution 2014 -21, A Resolution of the City Council of the City of Newport Beach
Limiting the Parking of Vehicles on Certain Streets and Rescinding Resolution No. 2009 -62,
for the removal of existing two (2) hour parking restriction on West 16th Street from Babcock
Street to Placentia Avenue.
FUNDING REQUIREMENTS:
The current adopted budget includes sufficient funding for this item.
DISCUSSION:
Staff recently received a request from a property and business owner on West 16th Street to
review the current 2 -hour parking limit for all of West 16th Street from Monrovia Avenue to
Placentia Avenue. He stated that the over flow parking associated with the construction of a
new assisted living facility (in Costa Mesa) coupled with the current two (2) hour parking

restrictions on West 16th Street from Babcock Street to Placentia Avenue has negatively
affected businesses on the street.
In 1971, the City Council approved a Resolution to limit the parking of vehicles to two (2)
hours on both sides of 16th Street, between Babcock Street to Placentia Avenue. A copy of
the City Council staff report from 1971 could not be located to determine the reasons for the
original establishment of the two (2) hour restriction. However, with expanded development
in the area and changes to local businesses, the existing two (2) hour parking restriction is
no longer required or appropriate.
A survey was sent to current property owners and tenants who take access to West 16th
Street, notifying them of the request to change on- street parking conditions. The survey
outlined the following three options: 1) keep the existing parking restriction; 2) extend the
two (2) hour parking restriction westerly to Monrovia Avenue; or 3) remove all parking
restrictions on West 16th Street. Responses received provided for mixed and inconclusive
results.
Upon completion of the assisted living facility, staff has observed that West 16th Street is
unable to handle the parking demands. Compounding the parking problems is the uneven
distribution of parking, with the unrestricted section of West 16th Street more impacted than
the section with two (2) hour parking restriction. To improve the parking balance, and to
lessen impacts to many area businesses, staff recommends removal of the existing two (2)
hour parking restriction on West 16th Street from Placentia Avenue to Babcock Street
through adoption of the proposed Resolution.
Letters were sent to current property owners and tenants notifying them of the
recommended removal of parking restriction and the opportunity to provide comments at the
March 11, 2014 City Council meeting.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment) and
15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential
for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item).

RESOLUTION NO. 2014-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH LIMITING THE PARKING OF
VEHICLES ON CERTAIN STREETS AND RESCINDING
RESOLUTION NUMBER 2009 -62
WHEREAS, Newport Beach Municipal Code Section 12.44.010(B) provides that
when authorized signs are in place giving notice thereof, no person shall stop, stand, or
park any vehicle between the hours of 8:00 a.m. and 6:00 p.m. of any day for a period of
time longer than two (2) hours upon such streets or portions thereof as the City Council
shall designate by resolution; and
WHEREAS, Newport Beach Municipal Code Section 12.44.010(C) authorizes the
City Council to vary the hours or days of parking restrictions when special parking or traffic
conditions exist; and
WHEREAS, pursuant to the authority found in Sections 12.44.010(B) and (C) the
City Council adopted Resolution No. 2009 -62 establishing a comprehensive set of parking
regulations within the City; and
WHEREAS, the City Council now desires to repeal Resolution No. 2009 -62 and
amend the parking regulations based upon the special parking and traffic conditions that
currently exist within the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport
Beach as follows:
Resolution No. 2009 -62 is rescinded and replaced with this Resolution.
2. The parking of vehicles between the hours of 8:00 a.m. and 2:00 p.m. on
school days is limited to two (2) hours on the following streets:

St. James Road 15th Street to and including 625 on the north side and
on the south side from 15th Street to and including 636
Signal Road 15th Street southerly to and including 418 on the east
side and 419 on the west side of Signal Road.
Snug Harbor Road Clay Street southerly to and including 406 on the east
side and 401 on the west side of Snug Harbor Road.
Pirate Road Clay Street southerly to and including 424 on the east
side and 427 on the west side of Pirate Road.
Clay Street South side, St. Andrews to 15th Street.
St. Andrews Road 15th Street to Haven Place; Clay Street to alley south
of Clay on the west side; Clay Street to and including
400 on the east side of St. Andrews Road.
15th Street North side, Irvine Avenue to Michael Place; Clay Street
to Kings Place. South side, alley west of Irvine Avenue
to Irvine Avenue; 210 feet east of Irvine Avenue to 310

8. The parking of vehicles between the hours of 8:00 a.m. and 5:00 p.m. on
weekdays is limited to two (2) hours on the following streets:
Tustin Avenue Avon Street to 300 feet northerly of Avon Street.
Ocean View Tustin Avenue to 350 feet northerly of Tustin Avenue.

9. The parking of vehicles between the hours of 8:00 a.m. and 4:00 p.m.
Monday through Saturday is limited to two (2) hours on the following street:
Cliff Drive South side from the westerly limit of Cliff Drive Park to
San Bernardino Avenue
BE IT FURTHER RESOLVED that the City Traffic Engineer is hereby directed to
erect or remove all necessary signs to indicate the parking restrictions contained herein.
BE IT FURTHER RESOLVED that Resolution No. 2009 -62 be and hereby is
rescinded.
