A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH RE- ESTABLISHING AN OVERNIGHT
PARKING PERMIT SYSTEM FOR THE USE OF PARKING
SPACES IN THE BALBOA MUNICIPAL LOT AND RESCINDING
RESOLUTION NO. 95 -135.
WHEREAS, Section 12.12.050 of the Newport Beach Municipal Code provides that, in a
City parking lot, a vehicle may be parked and remain parked in a parking space if such vehicle
has displayed a current, valid overnight parking permit issued by the City of Newport Beach,
pursuant to authorization of the City Council; and
WHEREAS, the City Council of the City of Newport Beach wishes to establish a Balboa
Municipal Lot Overnight Parking Permit and designate the fees and regulations governing the
use of said Permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport
Beach as follows:
1. There is hereby established a parking permit system consisting of a
non - transferable, annual Overnight Parking Permit which, when affixed to the front windshield of
a vehicle within a seven -inch (7) square in the lower corner farthest removed from the driver's
position, shall authorize the overnight parking of such vehicle in the Balboa Municipal Lot. The
Master Parking Permit shall be valid for overnight parking in the Balboa Municipal Lot. The
Annual Parking Permit shall not be valid for overnight parking in the Balboa Municipal Lot.
Overnight parking is hereby defined for this parking lot to mean between the hours of 3:00 a.m.
to 6:00 a.m. It shall not, however, establish any priority for parking spaces.
2. The Overnight Parking Permit established pursuant to this Resolution shall allow
a vehicle to remain in the Balboa Municipal Parking Lot continuously for a period of up to seven
(7) days without the payment of the regular parking fee.
3. The Overnight Parking Permit established pursuant to this Resolution shall not
be used for the parking of buses. For purposes of definition within this Resolution, the term
"bus" shall mean any motor vehicle, other than a motor truck or truck tractor, designed for
carrying more than nine (9) people, including the driver, and used or maintained for the
transportation of passengers.
4. The Overnight Parking Permit established pursuant to this Resolution shall not
be usable for vehicles 84 inches or more in width AND more than 84 inches in height OR more
than 20 feet in length OR without windshields.
5. The Overnight Parking Permit hereinbefore established shall be appropriately
designed and dated to indicate the appropriate year during which said Overnight Parking Permit
shall be valid.
6. The adoption of this Resolution shall not be construed to impair the validity of any
existing Overnight Parking Permit, and all said Overnight Parking Permits shall continue to be
effective for the term issued therefore.
7. The annual fee for the Balboa Municipal Lot Overnight Parking Permit shall be
two hundred twenty -five dollars ($225.00). Thereafter, the fee will be increased each year,
based upon any interim increase in the Consumer Price Index (the Los Angeles, Long Beach
and Anaheim Index). This increase shall be rounded to the nearest whole dollar and shall
become effective on January 1 of any year that the City Council does not otherwise revise the
fee.
8. Overnight Parking Permits purchased on or after October 1 of any year shall
have the fee reduced seventy -five percent (75 %).
9. Persons 65 years of age or older may purchase a total of one (1) Overnight
Parking Permit at a reduced rate, which shall be fifty percent (50 %) of the regular fee which is
set forth in this Resolution, subject to the satisfactory evidence of the following:
(a) Proof of age; and
(b) That the vehicle for which an Overnight Parking Permit is requested be
registered to and driven by the person requesting said permit.
10. Persons who have served or are serving in the United States military may
purchase a total of one (1) Overnight Parking Permit at a rate, which shall be reduced twenty -
five percent (25 %) of the regular fee, subject to the satisfactory evidence of the following:
(a) Military identification; and
(b) That the vehicle for which an Overnight Parking Permit is requested be
registered to and driven by the person requesting said permit.
BE IT FURTHER RESOLVED that Resolution No. 95 -135 be and hereby is rescinded.
