TITLE: Community Development Block Grant, 2010-2014 Consolidated Plan Substantial
Amendment
ABSTRACT:
The City receives Federal Community Development Block Grant ("CDBG") funds from the U.S.
Department of Housing and Urban Development ("HUD") each year to address priority needs
identified in the City's Consolidated Plan. The submission of a 3 or 5 -year Consolidated Plan is
required in order to receive the CDBG grant. The current operative Consolidated Plan was
approved April 27, 2010, and submitted to HUD covering the period of July 1, 2010 — June 30,
2015. In that Consolidated Plan, the City established certain numeric accomplishment goals to
address community needs identified in the Consolidated Plan. This substantial amendment does
not amend the needs assessment, market analysis or priority needs established in the 2010-
2014 Consolidated Plan, but rather amends the 5 -year numeric accomplishment goals to reflect
anticipated program performance for the remainder of the 5 -year Consolidated Plan period,
which ends on June 30, 2015. This amendment has no impact on funding levels from HUD.
RECOMMENDATION:
a) Hold a public hearing to receive comments on the Draft 2010-2014 Consolidated Plan
Substantial Amendment; and
b) Adopt Resolution No. 2014-32 (Staff Report Attachment CC -1), A Resolution of the City
Council of the City of Newport Beach Approving a Substantial Amendment of the Community
Development Block Grant (CDBG) 2010-2014 Consolidated Plan, finding the approval of the
2010-2014 Consolidated Plan Substantial Amendment exempt from the National Environmental
Policy Act and California Environmental Quality Act, and approving the Substantial Amendment
(Staff Report Attachment CC -3), and authorizing the submission of the Substantial Amendment
to HUD.

FUNDING REQUIREMENTS:
There is no fiscal impact to the General Fund related to this item. This item provides for City
Council approval of the 2010-2014 Consolidated Plan Substantial Amendment which amends
the 5 -year numeric accomplishment goals.
DISCUSSION:
As indicated, this substantial amendment of the City's 5 -year Consolidated Plan only amends
the 5 -year numeric accomplishment goals to reflect anticipated program performance for the
remainder of the 5 -year Consolidated Plan period, which ends on June 30, 2015. Existing
numeric goals, proposed changes to those goals and the reasons for the change are provided
in Attachment CC -2.
ENVIRONMENTAL REVIEW:
The development of required plans and allocation of CDBG program funds is an administrative
activity exempt under 24 CFR Part 58, Section 58.34 of the National Environmental Policy Act
of 1969 ("NEPA"), as amended.
Staff recommends the City Council find this action is not subject to the California Environmental
Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or
reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the
activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to
the environment, directly or indirectly.
NOTICING:
In accordance with HUD requirements for a 30 -day public review and comment period, notice of
the public hearing was published in the Daily Pilot on March 20, 2014. Further, the agenda
item has been noticed according to the Brown Act (72 hours in advance of the meeting at which
the City Council considers the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH APPROVING A SUBSTANTIAL AMENDMENT OF THE
COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) 2010-2014
CONSOLIDATED PLAN
WHEREAS, the City of Newport Beach participates in the Department of
Housing and Urban Development's Community Development Block Grant (CDBG); and
WHEREAS, on August 26, 2009, the City of Newport Beach's Planning
Department conducted a Community Meeting with Newport Beach residents and
community based organizations to evaluate the current level of services offered and to
identify any new community needs; and
WHEREAS, the Department of Housing and Urban Development (HUD) requires
the City to prepare a 5 -year "Consolidated Plan" document for the CDBG program and
the 2010-2014 Consolidated Plan was adopted by the City Council on April 27, 2010;
and
WHEREAS, on March 20, 2014, the City published a public notice in the Daily
Pilot newspaper indicating that the draft 2010-2014 Consolidated Plan Substantial
Amendment would be available to the public for review and comment from March 21,
2014 to April 22, 2014; and
WHEREAS, the City Council has considered the substantial amendment to its
adopted 2010-2014 Consolidated Plan which amends solely the 5 -year numeric
accomplishment goals to reflect anticipated program performance for the remainder of
the 5 -year Consolidated Plan period; and
WHEREAS, this substantial amendment has no impact on funding levels from
HUD; and
WHEREAS, the City Council finds this action exempt under 24 CFR Part 58,
Section 58.34 of the National Environment Policy Act of 1969 (NEPA), as amended;
and
WHEREAS, the City Council finds this action not subject to the California

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The 2010-2014 Consolidated Plan is amended by changing some
of the 5 -year numeric accomplishment goals, attached hereto as Exhibit A, the City's
2010-2014 Consolidated Plan Substantial Amendment. The 2010-2014 Consolidated
Plan Substantial Amendment is hereby approved and adopted.
SECTION 2. That the City Council authorizes the Community Development
Director, or his/her designee, to be the official representative of the City of Newport
Beach to submit the 2010-2014 Consolidated Plan Substantial Amendment to HUD.
PASSED, APPROVED, AND ADOPTED by the City Council of the City of Newport
Beach at a regular meeting held on the 22"d day of April 2014.

I. Background
Each year, the City of Newport Beach receives federal funds from the U.S.
Department of Housing and Urban Development (HUD) to implement a variety of
housing, community and economic development activities. The funds are from the
Community Development Block Grant (CDBG) program. The program is subject to
the HUD Consolidated Plan regulations found at 24 CFR Part 91, which requires the
City to prepare a five-year Consolidated Plan, Annual Action Plans and Consolidated
Annual Performance and Evaluation Reports. The regulations require citizen
participation as part of the development and approval of these documents.
The Consolidated Plan includes an assessment and prioritization of housing and
community needs, a list of local, state and federal resources that are available to
meet identified needs and Newport Beach's local strategies to address priority
needs over the five-year period. The current operative Consolidated Plan was
approved April 27, 2010 and submitted to HUD covering the period of July 1, 2010
- June 30, 2015.
According to the City's current adopted Citizen Participation Plan, changes to the
Consolidated Plan are considered "Substantial Amendments" when any of the
following occurs:
• The Citizen Participation Plan is altered;
• The City's housing goals or objectives are altered;
• The City's non -housing goals or objectives are altered; or
• HUD awards additional funds for new initiatives, as they become available.
Substantial Amendments require a public review and comment period with a formal
notice published in the Daily Pilot newspaper announcing the availability of the
Substantial Amendment Document at the Newport Beach Central Library,
Community Development Department, and City Clerk's Office for a period of 30
days. The public review period ends with the conclusion of the Public Hearing before
the City Council at the regularly scheduled meeting designated in the public notice.
II. 2010-2014 Consolidated Plan Amendment
The City established certain numeric accomplishment goals in connection with the
priority needs and strategic plan goals identified in the 2010-2014 Consolidated
Plan. Those goals were established based on an evaluation of past performance and
of funds anticipated to be available during the 5 -year period.
This substantial amendment does not amend the needs assessment, market
analysis or priority needs established in the 2010-2014 Consolidated Plan, but
rather amends the 5 -year numeric accomplishment goals to reflect anticipated
program performance for the remainder of the 5 -year Consolidated Plan period,
which ends on June 30, 2015. This amendment has no impact on funding levels
from HUD.

A copy of the Public Notice and the draft 2010-2014 Consolidated Plan Amendment
has been on file for public review in the Community Development Department, City
Clerk's Office, and the Newport Beach Central Library for a period of 30 days.
In accordance with the City of Newport Beach Citizen Participation Plan, a public
notice was published in the Daily Pilot newspaper on March 20, 2014 notifying the
public of this Substantial Amendment and of the opportunity to submit written
comments to the City Clerk or to provide oral comments during the Public Hearing
before the City Council at 7:00 p.m. on Tuesday April 22, 2014.
Written comments received by the Clerk and any oral testimony received during the
Public Hearing will be summarized and submitted to HUD with the City's transmittal
of the Substantial Amendment to the Consolidated Plan.

Council Chambers at 100 Civic Center Drive, Newport Beach. The City Council of the City of Newport Beach will consider the
approval of a substantial amendment to the 2010-2014 Consolidated Plan in connection with its U.S. Department of
Housing and Urban Development (HUD) Community Planning and Development Grant (CDBG) program.
Draft 2010-2014 Consolidated Plan Substantial Amendment - The City of Newport Beach has prepared the Draft
2010-2014 Consolidated Plan Substantial Amendment, which changes the City's 5 -year numeric accomplishment goals to
revise the City's estimated accomplishments over the 5 -year period to reflect current projections based on the first three
(3) years of the planning period as well as changes to market conditions and available financial resources since 2010.
NOTICE IS HEREBY FURTHER GIVEN that approval of the Consolidated Plan Substantial Amendment is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct

a public hearing will be conducted in the City Council Chambers at 100.Civic
Center Drive, Newport Beach. The City Council of the City of Newport Beach wil
consider the approval of a substantial amendment to the 2010-2014 Consolidated
Plan in connection with its U.S. Department of Housing and UrbanDevelopment
(HUD) Community Planning and Development Grant (CDR%program.
Draft 2010-2014 Consolidated Plan Substantial Amendment - The City of
Newport Beach has prepared the Draft 2010-2014 Consolidated Plan Substantial
Amendment, which changes the City's 5 -year numeric accomplishment goals
to revise the City's estimated accomplishments over the 5 -year period to reflect
current projections based on the first three(3) years of the planning' period as well
as changes to market conditions and available financial resources since 2010.
NOTICE IS HEREBY FURTHER GIVEN that approval of the Consolidated Plan
Substantial Amendment is not subject to the California Environmental Quality
Act ("CEQA') pursuant to Sections 15060(c)(2) (the activity will not result in a
direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the
CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because
it has no "potential for resulting in, physical change to the environment, directly
or indirectly.
NOTICE IS HEREBY FURTHER GIVEN that the publication of this notice
commences a minimum 30 -day public review period as required under Federal
Regulation 24 CFR 91.105(b)(2). This public review and comment period begins
