Federal Court retained jurisdiction History of Settlement Agreement ❑ Settlement Agreement Details Limited the size of the commercial passenger terminal to 271,00 square feet and 8,400 parking spaces Established three "classes" of commercial aircraft based on noise generated by aircraft L Limited the number of Average Daily Departures ( "ADD ") per year to 73 Limited the number of passengers deplaning and enplaning to 8.4 Million Annual Passengers Required the County to maintain the curfew and enforce the noise ordinance Amendments ❑ FAA Advisory Circular for noise abatement departure procedures ❑ Changes in location and /or type of equipment used to monitor noise levels ❑ Air cargo carrier requests for access ❑ Changes in passenger, facility, baggage security requirements :J ANCA ❑ Exempt from ANCA: The 1985 Settlement Agreement Amendments to the Settlement Agreement, that do not further reduce or limit aircraft operations or affect aircraft safety r County noise "curfew" ordinance 2003 Extension ❑ 2003 Amendment Eliminated the "AA' class of aircraft Increased the maximum number of noise regulated air carrier Average Daily Departures from 73 to 85 Increased the maximum number of air cargo Average Daily Departures from 2 to 4 Increased the number of deplaning and enplaning passengers to 10.8 Million Annual Passengers through December 31, 2015 2003 Extension ❑ 2003 Amendment r The curfew remained unchanged Increased the number of passenger loading bridges from 14 to 20 Eliminated the "cap" on public parking spaces Eliminated the floor area restrictions on the size of the terminal Settlement Agreement Extension ❑ Settlement Agreement Term Flight and service level restrictions are effective through December 31, 2015 Curfew is effective through 2020 MOU defining the "Proposed Project" entered into April 2013 City's Preferred Project = "Proposed Project" ❑ Protection and extension of the noise -based curfew through 2035 ❑ Maintenance of the Million Annual Passenger cap 10.8 MAP through 2020 1 1.8 MAP through 2025 12.2 or 12.5 MAP through 2030 Ei Maintenance of the cap on the average daily departures of the Class A flights 85 passenger flights and 4 cargo flights through 2020 95 passenger flights and 4 cargo flights through 2030 ❑ Maintenance of the limit on passenger loading bridges through 2020 California Environmental Quality Act (CEQA) ❑ Environmental Analysis County is the Lead Agency and City of Newport Beach is a Responsible Agency An EIR is an informational document designed to provide the public with detailed information about the likely effect of the proposed project on the environment and how any adverse effects or the proposed project might be minimized California Environmental Quality Act (CEQA) r7 Why discuss alternatives?
