TITLE: Adoption of Recycled Water Rates
ABSTRACT:
The City of Newport Beach provides non - potable (recycled) water for the purposes of irrigating parks,
school landscaping, center medians and golf courses. Recycled water is purchased from the Orange
County Water District through the Green Acres Project. The current charge for recycled water includes fixed
fees and a commodity rate set at 80% of the potable water rate. The Municipal Operations Department
retained the consulting services of HF &H Consultants, LLC (HF &H) to prepare a recycled water rate study.
The study analyzed the cost of service. The study recommended a revised rate structure.
RECOMMENDATION:
a) Conduct a public hearing to accept comments on the proposed recycled water rate and, at the
conclusion of the hearing close the 45 -day written protest period;
b) Affirm the tabulated results of the recycled water rate protest count from property owning customers;
and
c) Introduce Ordinance No 2014 -13, An Ordinance of the City Council of the City of Newport Beach
Amending the Newport Beach Municipal Code to Add Chapter 14.13 Regarding Recycled Water Rates, and
pass to second reading on September 9, 2014.
FUNDING REQUIREMENTS:
There are no funding requirements to implement the recycled rate and /or structure; however this action will
change the recycled water rate and structure currently being charge to users of recycled water.
DISCUSSION:
On June 10, 2014, the Municipal Operations Department presented to Council a technical memorandum
that discussed the proposed recycled water rate and structure. Attachment B to this document shows the
current and proposed rates for recycled water. The City Council reviewed the results and directed staff to
send out a notice to all customers in compliance with State law.
Pursuant to State Law, the rates charged to recycled water users may be adjusted following a public
hearing. If at the public hearing, protests from more than half of the number of properties served by the City
are received, then the modified rate structure may not be implemented.
On June 23, 2014, the City Clerk mailed notices to all property owners for which the city provides recycled
water. A 45 -day notice period concludes at the end of the public hearing on August 12, 2014. The City
Clerk shall complete the tabulation of all written protests received, including those received during the
public hearing and shall report the results to the City Council.
If there is an absence of a majority written protest, staff recommends Council approve of the rate and
structure adjustment and introduce an ordinance creating Chapter 14.13.010 Recycled Water Rates
Established of the Newport Beach Municipal Code, and pass to second reading on September 9, 2014.
The new recycled water rate and structure will go into effect 30 days after the second reading of the
ordinance (approximately October 10, 2014). The next rate adjustment will be effective on January 1, 2016,
and on the first day of each year thereafter.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental Quality Act
( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in
Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).

OF NEWPORT BEACH AMENDING THE NEWPORT
BEACH MUNICIPAL CODE TO ADD CHAPTER 14.13
REGARDING RECYCLED WATER RATES
WHEREAS, The City of Newport Beach provides non - potable (recycled) water
for the purposes of irrigating parks, schools, center medians and golf courses.
Recycled water is purchased from the Orange County Water District through the Green
Acres Project; and
WHEREAS, The City charges users of recycled water a rate set at 80% of the
potable water rate; and
WHEREAS, The City's Municipal Operations Department retained the consulting
services of HF &H Consultants, LLC ( "HF &H ") to prepare a recycled water rate study in
order to analyze the current cost to the City to provide recycled water and to provide
recommendations regarding an appropriate rate structure; and
WHEREAS, The HF &H study recommended a revised rate structure that
includes a fixed fee component, a commodity charge and a pump station charge if the
recycled water is provided by a pump station that is maintained by the City; and
WHEREAS, The City Council has reviewed the conclusions of the HF &H study
and agrees that the recommended rate structure should be implemented, which will
allow the City to charge the users of recycled water a rate that reflects the City's current
cost of providing recycled water.
NOW THEREFORE, the City Council of the City of Newport Beach ordains as
follows:
Section 1: Section 14.13.010 is hereby added to the Newport Beach Municipal
Code to read as follows:
14.13.010 Recycled Water Rates Established. Recycled water, also known as
'.reclaimed" water, is used as a conservation measure to reduce potable drinking
water demand. Recycled water is non - potable, treated wastewater used for
landscape irrigation including but not limited to: park landscape areas, school
landscape areas, roadway medians and parkways, and golf course landscaping.
The city purchases recycled water pursuant to an agreement with the Orange
County Water District (OCWD).
Upon the effective date of this chapter, a recycled water fixed rate,
commodity charge, and pump station rate shall be established, and users
of recycled water shall be charged these rates in accordance with the
provisions of this chapter.
A. There shall be charged and collected a monthly fixed recycled water
service charge from each customer for each meter. The fixed water service
charge recaptures the City's costs to operate and maintain the recycled water
system, including required capital infrastructure improvements, but excluding
pump station maintenance, repairs and improvements.
Fixed water service charges shall be effective January 1st of each year and
charged according to the Fee Schedule adopted by resolution of the City Council.
B. There shall be charged and collected a monthly commodity charge from
each customer for each meter. The commodity charge is a per unit charge that
recaptures the City's cost to purchase recycled water from OCWD. If the City's
cost of recycled water increases by more than the projected rate to purchase
water from OCWD, the commodity charge will be adjusted annually to reflect the
City's cost to purchase recycled water from OCWD. The commodity charge shall
be effective January Vt of each year and charged according to the Fee Schedule
adopted by resolution of the City Council.
C. There shall be charged and collected a monthly pump station charge from
each customer receives water by means of a pump station. The pump station
charge recaptures the City's cost to operate, repair, maintain, and replace the
pump stations that may be necessary to provide recycled water.
Pump station charges shall be effective January 1st of each year and charged
according to the Fee Schedule adopted by resolution of the City Council.
Section 2: The recitals provided in this ordinance are true and correct and are
incorporated into the substantive portion of this ordinance.
Section 3: If any section, subsection, sentence, clause or phrase of this
ordinance is for any reason held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this ordinance. The
City Council hereby declares that it would have passed this ordinance and each section,
subsection, clause or phrase hereof, irrespective of the fact that any one or more
sections, subsections, sentences, clauses and phrases be declared unconstitutional.
Section 4: The City Council finds the approval of this ordinance is not subject
to the California Environmental Quality Act ( "CEQA ") pursuant to Section 15060(c)(2)
(the activity will not result in a direct or reasonably foreseeable indirect physical change
in the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential to have a significant effect on the environment.
Section 5: Except as expressly modified in this ordinance, all other Sections,
Subsections, terms, clauses and phrases set forth in the Newport Beach Municipal
Code shall remain unchanged and shall be in full force and effect.
Section 6: The Mayor shall sign and the City Clerk shall attest to the passage
of this ordinance. The City Clerk shall cause the ordinance, or a summary thereof, to be
published once in the official newspaper of the City, and it shall be effective thirty (30)
days after its adoption.
This Ordinance was introduced at a regular meeting of the City Council of the
City of Newport Beach held on the 12th day of August, 2014, and adopted on the gth
day of September, 2014, by the following vote, to -wit:

NOTICE IS HEREBY GIVEN that on Tuesday, August 12, 2014, at 7:00 p.m. or soon thereafter as the
matter shall be heard, a public hearing will be conducted in the City Council Chambers at 100 Civic
Center Drive, Newport Beach. The City Council of the City of Newport Beach will consider the following:
RECYCLED WATER RATES The City of Newport Beach provides non - potable (recycled) water to users
in the City for the purposes of irrigating parks, schools, center medians, and golf courses. The City
acquires recycled water from the Orange County Water District pursuant to the Green Acres water
reclamation project, which was established in 1991. The City currently charges users of recycled water a
fixed fee and a commodity rate set at 80% of the potable water rate.
In 2013, the Municipal Operations Department retained the consulting services of HF &H Consultants,
LLC to complete an analysis of the City's recycled water rate and provide recommendations as to a rate
structure that, if adopted, would enable the City to distribute costs equitably amongst the City's users of
recycled water. The study prepared by HF &H analyzed the cost of service and concluded that a rate
adjustment is appropriate. Prior to the publication of this notice, the City provided written notice of the
proposed rate structure to its recycled water customers.
NOTICE IS HEREBY FURTHER GIVEN The project is exempt under Section 15060(c)(2), of the State
CEQA (California Environmental Quality Act) Guidelines because it will not result in a direct or
reasonably foreseeable indirect physical change in the environment.
NOTICE IS HEREBY FURTHER GIVEN All affected recycled water users were properly noticed as
required by California statutes including, but not limited to, Proposition 218. Under the Proposition 218
requirements, the rates will not be adjusted if a majority of the users of recycled water submit a valid
written protest to the City Clerk by the close of the 45 -day notice period. If the total number of protests
is less than half of the number of properties served by the City, then the Clerk may advise the City
Council of the absence of a majority protest without determining the validity of all protests.
All interested parties may appear and present testimony in regard to this change. If you challenge this
project in court, you may be limited to raising only those issues you raised at the public hearing or in
written correspondence delivered to the City, at, or prior to, the public hearing. The change may be
continued to a specific future meeting date, and if such an action occurs, additional public notice of the
continuance will not be provided. Prior to the public hearing the agenda, staff report, the recycled water
rate study and documents may be reviewed at the City Clerk's Office, at 100 Civic Center Drive, Newport
Beach, California, 92660 or at the City of Newport Beach website at www.newportbeachca.gov.

Proposed Recycled Water Rate Change
Notice of Public Hearing and Protest Procedure
NOTICE IS HEREBY GIVEN that on August 12, 2014, at 7:00 p.m., a public hearing will be
conducted in the City Council Chambers at 100 Civic Center Drive, Newport Beach, CA 92660.
This will be a public hearing before the Newport Beach City Council to allow public testimony
and discussion of the proposed recycled water rate adjustments described within this notice.
The City Council will take written and oral comments that evening. They will also consider all
written protests against the proposed charges, determine if a majority protest exists, and
consider resolutions to adopt the recycled water rate charges.
How to File a Written Protest
Written protests must be filed with the City of Newport Beach City Clerk. Written protests may
be hand delivered or mailed to the City Clerk at 100 Civic Center Drive, Newport Beach,
California 92660. To be valid, written protests must state opposition to the proposed recycled
water rate adjustment, identify the parcel (by assessor's parcel number or street address), and
include the original signature of the recycled water service customer or property owner. Written
protests may be submitted up to the conclusion of the public testimony at the public hearing on
August 12, 2014.
About Proposition 218
In November 1996, California voters approved Proposition 218. As a result, California agencies
must comply with its requirements when setting utility rates. One provision requires that a
noticed public hearing on utility rates be held and that rates not be increased if a majority of
affected property owners protest the increased rates in writing.

Q. What does my recycled water bill pay for?
A. Your Newport Beach recycled water bill covers the following categories costs and services:
• The annual operation and maintenance of the recycled water system, including meter
reading and replacement, overhead and administrative costs, and other agency fees.
• The cost the City incurs to purchase recycled water from the Orange County Water
District (OCWD).
• The pump station costs, including inspections, maintenance, rehabilitation, and
replacements.
Q. Why do the rates need to be adjusted?
A. Recycled water is treated wastewater provided by OCWD under the Green Acres Project
(GAP). GAP is a water conservation effort that provides recycled water for landscape irrigation at
parks, schools, center medians, and golf courses.

In 1991, the City entered into an agreement with OCWD for the distribution and sale of GAP
water. The agreement stipulates that recycled water rates may not exceed 80% of the potable
water rate. The agreement term is for 25 years with five 5 -year automatic extensions, with an
estimated ending term year of 2041.
Following the 1991 agreement, the City entered into "End User Agreements" with customers in
1996 for a 10 -year term. These agreements have now expired with the exception of the Big
Canyon Country Club who entered into a new agreement in 2011 for the delivery and sale of
recycled water and a pump station license agreement. All past and current agreements set the
recycled water usage fee rate at 80% of the potable water usage fee rate.
In the last nineteen years the potable water rates have increased significantly mostly due to
increased import water costs from Northern California and Colorado River. Recycled water rates
have tracked these rate increases. Our customers and staff recognized the need to set the
recycled rate to the true cost to provide this service.
Q. How will my recycled water bill be calculated?
A. A customer's recycled water bill is a component of the municipal services statement sent to
City customers. Each bill will have three components:
1. Water Service Charge (Fixed): This charge is based on the customer's water meter size.
This charge is designed to recover the costs of reading, maintaining, and replacing the
water meters. Additionally, this charge includes administrative and overhead costs.
2. Water Usage Fee (Variable): This charge is based on the amount of water used and is
calculated by multiplying the number of hundred cubic feet units (HCF) of water used by
the unit rate per HCF. One HCF is equal to 748 gallons. This charge is geared towards
recovering the costs associated with the City's cost to purchase water from OCWD.
In the event OCWD increases the cost of recycled water by more than the projected
rate, the commodity rate will be adjusted to reflect the actual commodity cost charged by
OCWD.
3. Pump Station Fee (Variable): This charge is based on the costs associated with the use
of Pump Stations and is calculated by multiplying the number of HCF units used by the
unit rate per HCF. Only users of the pump stations will be charged. This charge covers
the cost for inspections, maintenance, rehabilitation, and station replacement.
Q. How long is the rate increase in effect?
A. The City is proposing a five -year rate establishment. Years two through five are based on a
two percent increase based on historical increases due to cost of water, materials, and
manpower. The water usage fee is based on the City's cost to purchase water from OCWD.
Although estimated to increase by two percent per year, this portion of the rate will be
adjusted annually to match the City's cost to purchase the water. The rate may increase or
decrease based on OCWD's cost to provide recycled water.
Q. How does this compare to what we currently pay?
A. The City currently has five customers and fourteen connections. In all cases, the monthly
cost to purchase recycled water from the City is decreasing. The average reduction in
customer costs range from 44% to 60% depending on amount of water used.
