TITLE: Appointment to the Environmental Quality Affairs Committee (EQAC)
ABSTRACT:
Due to the resignation of Merritt Van Sant from the Environmental Quality Affairs Committee (EQAC), the
City Council may apoint a new member pursuant to City Council Policy A -2 (Board, Commission, and
Committee Appointments).
RECOMMENDATION:
Appoint either Scott Kohan, James Mosher, Joan Penfil, or Mark Tabbert to fill the unexpired balance of
Merritt Van Sant's term which expires on February 26, 2017.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
Merritt Van Sant resigned from his seat on EQAC. His term is scheduled to expire on February 26, 2017.
Pursuant to City Council Policy A -2, the City Council may appoint someone to serve the remainder of Mr.
Van Sant's unexpired term.
Pursuant to City Council Policy A -2 and the Maddy Act, the City Clerk prepared and posted a Notice of
Unscheduled Vacancy on Thursday, June 26, 2014 in the City Clerk's Office, at the Central Library, and on
the bulletin board in the City Council Chambers. The Notice of Unscheduled Vacancy was also posted on
the City's webpage on Thursday, June 26, 2014, and was published in the Daily Pilot on Saturday, July 5,
2014. Pursuant to the Notice of Unscheduled Vacancy, applications were accepted by the City Clerk's
Office until noon on Friday, July 18, 2014.
At the conclusion of the application period, the City Clerk's Office received timely applications from Scott
Kohan, Joan Penfil, and Mark Tabbert. The City Clerk's Office also received an application after the
deadline from James Mosher. The City Council has the discretion to accept or reject Mr. Mosher's late
application. Copies of the four applications are attached as Attachment A.
Appointment Process
Pursuant to City Council Policy A -2, appointments to EQAC will take place in the following manner:
A. The City Council will vote on the appointment using a paper ballot and the City Clerk will tabulate and
announce the results, including the vote tally.
B. Each member of the City Council will cast one vote on the paper ballot. In order to be appointed, an
applicant must receive at least four votes.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California Environmental Quality Act
( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in
Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).

1) 1 want to be more involved with my community. I think strong community is foundational to all that really counts in life. I see EQAC as
a way to show my willingness to work constructively and be involved in a meaningful way. I ran for city council which clearly shows my
interest in Newport Beach.
2) 1 have love of the environment and have studied environmental issues at a graduate level at Claremont. The manner in which we deal
with environmental issues will determine our children's future.
3) 1 worked in the steel recycling industry for nearly 20 years and in addition to trading metals, i managed large scrap recycling industries
in Detroit, Iowa and Southern California. I have been involved numerous times with the EIR process while in the steel industry. In the
1980's and 1990's more stringent environmental rules and regulation made us all somewhat expert on land and water quality issues. A
scrap yard is in a true sense a waste management site.
4) If my position on the Banning Ranch Conservancy Board is seen as a conflict, as I think it would be, I would resign my position there.
Of course my hopes for Banning Ranch would not change but that could well be a plus at EQAC.
