TITLE: Unscheduled Vacancy on the City Arts Commission to Serve Until June 30, 2017
ABSTRACT:
Due to the resignation of Michaell Magrutsche, the City Council must fill the position vacated by Mr.
Magrutsche on the City Arts Commission.
RECOMMENDATION:
a) Declare a vacancy on the City Arts Commission due to the resignation of Michaell Magrutsche; and
b) Direct the City Clerk to post and publish a Special Vacancy Notice requesting that applications be
submitted by noon on Friday, September 19, 2014, and schedule the appointment by the City Council for
October 14, 2014.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
On June 25, 2013, the City Council appointed Michaell Magrutsche to the City Arts Commission, and on
August 11, 2014, Mr. Magrutsche resigned his seat on the City Arts Commission, as he no longer resides
in the City. Section 702 of the City Charter provides, in part, that "the members of [the Arts Commission]
shall be appointed by the City Council from the qualified electors of the City.... ". Charter Section 705
provides, in part, "if a member of a board or commission... ceases to be a registered elector of the City, his
or her office shall become vacant and shall be so declared by the City Council." His term was scheduled
to expire on June 30, 2017. Pursuant to Charter Section 702 and City Council Policy A -2, the City
Council's appointee to the City Arts Commission will serve Mr. Magrutsche's unexpired term.
Pursuant to the Maddy Act and City Council Policy A -2, the City Clerk prepared and posted a Special
Vacancy Notice on Wednesday, August 13, 2014 in the City Clerk's Office and at the Central Library. The
Notice was also placed on the City's webpage and was published in the Daily Pilot on Saturday, August 16,
2014. As per the Notice, applications will be accepted by the City Clerk's Office until noon on Friday,
September 19, 2014.
Following the close of the application period, the City Clerk will prepare the staff report, including
applications, for the appointment of the new member to the City Arts Commission. The appointment will
take place at the October 14, 2014 City Council meeting.

ENVIRONMENTAL REVIEW:
This action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060
(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in
physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).

The City of Newport Beach is currently accepting applications to fill a vacancy on the
CITY ARTS COMMISSION — One Seat
(term expires 6/30/17)
The City Arts Commission meets the 2 "d Thursday of the month at 5:00 p.m. in the City
Council Chambers.
An application can be obtained from the City Clerk's Office at 100 Civic Center Drive,
Bay E, 2 "d Floor, or can be sent to you by calling (949) 644 -3005. The application and
Commission information can also be accessed through the City's website at
www.newportbeachca.gov/vacancV.
The deadline for filing applications is noon on Friday, September 19, 2014. For more
