As the property owner of the CROWBAR restaurant, next to Ruby's,
located at 2325 East Coast Highway, in Corona del Mar, the requirement
that any redevelopment, major reconstruction, renovation or reuse will
require that the available parking (which is at 710 Acacia, directly behind
CROWBAR), facing Acacia, be made available to the public during "non
business hours" is onerous and opens up the property owner, business
operator (tenant) for liability -as an example:
1. Someone tripping and falling on the property -whose insurance will
cover the claim?
2. Someone being assaulted on the property exposes the owner to a
potential lawsuit.
3. Cars that are parked could leak oil or gasoline -that damages the
asphalt (it eats holes in it) -who pays for the repairs? Are you going to
help the property owner when the tenant says "it wasn't my
customers that damaged it, I shouldn't have to pay for it "?
4. Damage, or vandalism to the parked vehicle -whose insurance will
cover?
5. Damage to the adjacent property line block fence (we have had 2
incidents of vehicles driven into Korker Liquor (that we also own in
the next block) in the last 20 years, and 1 time here on Acacia (which
the vehicle left the scene, and we were left with the repairs).
6. What about large truck deliveries and service workers? Those occur
before "business hours ". Who is going to tow the cars that are in the
way?
7. Who at the city will help the property owner deal with the insurance
company when they deny a claim, as it is not a risk they normally
have. The insurance company only covers the owner, customers, or
invitees, not the general public to use the private property as a
public parking lot.
