L4 I .as -99 SUBJECT: RESOLUTION NO. 99 -_ PERTAINING TO ACCEPTANCE OF THE BAYVIEW LANDING PARCEL A AND PARCEL B IN PARCEL MAP 95 -137 (RESUBDIVISION NO. 1041) LOCATED ON THE NORTHWEST CORNER OF EAST COAST HIGHWAY AND JAMBOREE ROAD DEVELOPER: THE IRVINE COMPANY RECOMMENDATIONS: Accept the dedications as offered of Parcel A and Parcel B of Parcel Map 95 -137 (Resubdivision No. 1041) Bayview Landing open space park site and the area leased to Newport Dunes Development respectively and Authorize the City Manager and City Clerk to accept the offer and dedications of Parcel A and Parcel B of Parcel Map 95 -137. 2. Adopt Resolution No. 99- _accepting the offers and dedications of Parcel A and Parcel B of Parcel Map 95 -137; and direct the City Clerk to have the Resolution recorded in the Office of the Orange County Recorder. DISCUSSION: The Bayview Landing open space dedication was required as a part of the Circulation Improvement and Open Space Agreement ( CIOSA) with the Irvine Company. • Parcel B which is under a long -term lease to the Newport Dunes is a part of the open space dedication. The CIOSA agreement required that the Bayview Landing dedication contain 11.1 acres, Parcel A contains 9.990 acres and Parcel B contains 1.127 Acres which is slightly over the required 11.1 area by 0.017 acres. An Offer of Dedication has been prepared for acceptance of Parcel A and Parcel B of Parcel Map 95 -137 and must now be accepted by the City to complete the dedication process. An exhibit is attached for reference. A resolution has been prepared for the acceptance of the dedications and will be recorded with the Office of the Orange County Recorder upon City Council approval. WHEREAS, the City of Newport Beach approved Parcel Map 95 -137 (Resubdivision No. 1041) on December 14, 1998, which established Parcel A and Parcel B; and WHEREAS, Parcel A and Parcel B are offered to the City by The Irvine Company as open space parcels in conformance with the requirements of the "Circulation Improvement and Open Space Agreement' (CIOSA) executed between The Irvine Company and the City of Newport Beach; and WHEREAS, the open space parcels are legally described as Parcel A and Parcel B of Parcel Map 95 -137; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of • Newport Beach that the dedication of the open space of Parcels A and B of Parcel Map 95 -137 is hereby accepted in conformance with the requirements and conditions set forth in the CIOSA; and BE IT FURTHER RESOLVED that the Mayor be authorized to execute the Resolution of Acceptance, to be recorded in the Office of the Recorder of the County of Orange.
