RE: Environmental Nature Center /Request to Waive Fees
The Newport Mesa Unified School District (NMUSD) has agreed to sell approximately one
acre of land adjacent to the "Environmental Nature Center" to the public benefit
corporation bearing the same name. NMUSD and the Environmental Nature Center have
agreed to submit a tentative parcel map to the City to clearly identify the property to be
conveyed. The Environmental Nature Center and NMUSD have asked the City to waive
subdivision and other fees associated with the submittal and processing of the parcel
map — approximately $848.00 in this case.
Staff believes the fee waiver is justified. According to the Subdivision Map Act, a parcel
map is not required for conveyances to or from a governmental agency such as NMUSD.
Legal counsel for the Environmental Nature Center has recommended submittal of a
parcel map and the Public Works Director believes the recordation of a map will be
helpful to the City. Subdivision fees generally cover the staff time necessary to ensure
that the proposed design and improvements comply with City standards and conditions to
approval. This parcel map will not contain improvements or conditions so very little staff
time will be required. Finally, a waiver of fees is consistent with the spirit and intent of
special Subdivision Map Act provisions related to environmental subdivisions.
RECOMMENDATION
Staff recommends the City Council grant the request of the Environmental Nature Center
and NMUSD to waive subdivision and planning fees related to their proposed parcel map.
