SUBJECT: NEWPORT BEACH JAZZ FESTIVAL BANNERS
RECOMMENDATION:
1. Approve the request of Ritz Entertainment for the installation of 150 banners, from
April 1, 1999 to May 17, 1999. Installation shall be along Jamboree Road,
MacArthur Boulevard and Newport Center Drive East/West. Waive City Council
Policy L -16, which limits banners to a maximum of 100 to be installed for 30 days,
for this application.

DISCUSSION:
The applicant (Ritz Entertainment) has requested that 150 private banners be installed
from April 1, 1999 through May 17, 1999 in the Fashion Island area for the 6th Annual
Newport Beach Jazz Festival (see attached letter). The banners will be mounted on
street light poles along Jamboree Road (40 banners), Newport Center Drive East/West
(62 banners), and MacArthur Boulevard (48 banners) public right -of -way (see attached
Exhibit).
The Newport Beach Jazz Festival will be a weeklong event (May 8`h through the May
14`h) supported by the "Conference and Visitors Bureau ". The event is not co-
sponsored by the City of Newport Beach, not organized by a non - profit organization, not
free to the public, and does not exclude advertisement of the sponsor (Glen Ellen
Winery) as required per City Council Policy L -16. However, the event will be
community -wide, open to the public, and will create additional revenue to the City
through restaurants and hotel reservations.

The applicant's request to install 150 private banners from April 1, 1999 through May •
17, 1999 will exceed the 100 banners and the 30 calendar days allowed per City
Council Policy L -16. In the past, the following similar requests have been approved by
City Council: "Taste of Newport" (approved July 13, 1998) and Orange County Museum
of Art (approved October 12, 1998).
Council Policy L -16 prohibits the use of a commercial sponsor's name on the banner.
Staff notes that this sponsor is a winery and in the past the City Council has specifically
prohibited the advertising for alcoholic products on bus shelters.
There have been no reported public complaints, but during the past 6 months there
have been mechanical problems with some of the private Orange County Museum of
Art banner brackets and damage to the street light poles as a result of strong winds.
Some of the damaged street light poles show evidence of rust damage from
deterioration and/or vehicle damage. Wind slit openings on the banners can ease the
load during extremely windy conditions.
Should the City Council elect to approve the installation of 150 private banners in the
Fashion Island area for 47 days, staff recommends the following conditions of approval:
1. No banners shall be installed on traffic signal poles
2. On Newport Center Drive East/West (Ring Road) the locations shall be limited to the
center median.
3. The applicant must provide on -going maintenance of the banners and brackets.
4. The owner must sign a "Hold Harmless Statement" requiring maintenance of the
banners /brackets and indemnification and hold harmless for any liability associated
with the banners /brackets.
5. The owner must maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better, and a financial
size category of "VIII" or higher.
6. Issuance of an Encroachment Permit by the Public Works Department.
7. The banners shall conform to City Council Policy L -16 with the exception of the
number of banners, time extension, advertisement of sponsor, open to the public
free of charge, and co- sponsor by the City.
8. All banners and brackets shall be removed by the end of the approved time.
9. All banners and brackets shall comply with the Encroachment Permit conditions.

10. If needed, the removal of some of the banners to allow other organizations to install
banners at the same location and during the same time period.
11. Require a minimum of two 5" wide half - circle wind slits per banner to minimize the
wind load.
12. The printed font of the sponsor, "Glen Ellen ", shall be the same size or smaller than
the "Newport Beach Jazz Festival' font.

RE: Glen Ellen Wineries Newport Beach Jazz Festival
Dear Council Members,
My name is Eric Jensen and I am the President of Ritz Entertainment, Southern
California's largest producer of contemporary jazz music. The reason for my letter is to
offer some hackground on the 6th Annual Newport Beach Jazz Festival. which is held
every May at the Hyatt Newporter Resort. After some serious brainstorming with
Rosalind Williams of the Conference and Visitors Bureau we have decided to take the
traditional format of Saturday and Sunday and expand to a week of festivities spread
throughout the entire city. In the past we have booked the top national jazz acts on
Saturday and Sunday from 10a n till 8pm and had them each play for sixty minutes on two
different stages. The event, which usually sells out, has developed into one of the nation's
premier contemporary jazz festivals (contemporary being acts like Kenny G and David
Sanborn, not the older style of trio's using stand up base). The festival has always
attracted people from other counties and states, but has recently been attracting a large
international contingency.
Since the event has been a sell out the past several years we decided it is time to begin
expanding to a week -long event with concerts spread throughout the Newport Beach
community, similar to the San Francisco and New Orleans Jazz Festivals. Our goal is to
bring to our .wonderful city an event that fills hotel rooms and restaurants in a traditionally
slow month. The event already does a pretty good job of this but can obviously become
one of the City's marquis events with nationwide advertising. This year Rosalind went to
the local hotels and got nine of them to donate two night stays to accompany a West
Coast radio station giveaway that includes my company providing event tickets and
airfare to John Wayne Airport. For this we receive thousands of dollars of advertising
promoting the event and the contest in cities like Salt Lake, Phoenix, San Francisco,
Sacramento. Seattle, Portland and Monterey. Weekday events are taking place at the Hard
Rock Cafe, Twin Palms and Fashion Island.
For the past two years the event has donated a minimum of $5,000 as well as tons of
exposure to Human Options, a charity benefiting abused women and their children. One of
the best things about the festival is the upscale crowd it attracts. Obviously jazz draws a
different clientele than rock and rap, but our crowd also has a tremendous amount of class
and disposable income, as you will see by the rise in restaurant and hotel reservations May

assist us in making this festival one that continues to bring solid business to the city.
