TITLE: Appointment of a New City Arts Commissioner to Fill an Unscheduled Vacancy
ABSTRACT:
Due to Michaell Magrutsche's resignation, the City Council may appoint a person to fill the position vacated
by Mr. Magrutsche on the City Arts Commission.
RECOMMENDATION:
Appoint one of the persons that submitted an application to the City Arts Commission to fill the unexpired
balance of Michaell Magrutsche's term, which expires on June 30, 2017.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
On August 11, 2014, Commissioner Michaell Magrutsche resigned from his seat on the City Arts
Commission, due to his relocation outside of Newport Beach. His term is scheduled to expire on June 30,
2017.
Section 702 of the City Charter provides, in part, "the members of [the Arts Commission] shall be appointed
by the City Council from the qualified electors of the City... ... Charter Section 705 provides, in part, "if a
member of a board or commission... ceases to be a registered elector of the City, his or her office shall
become vacant and shall be so declared by the City Council." Pursuant to Charter Section 702 and City
Council Policy A -2 (Board, Commission, and Committee Appointments), the City Council's appointee to the
City Arts Commission will serve the remainder of Mr. Magrutsche's unexpired term.
The City Council declared the vacancy on the City Arts Commission at its September 9, 2014, City Council
meeting. Pursuant to the Maddy Act and City Council Policy A -2, the City Clerk prepared and posted the
Special Vacancy Notice on Tuesday, August 12, 2014, in the City Clerk's Office, at the Central Library, and
on the bulletin board in the City Council Chambers. The Special Vacancy Notice was also placed on the

City's webpage on Tuesday, August 12, 2014, and was published in the Daily Pilot on Saturday, August
16, 2014. As per the Special Vacancy Notice, applications were accepted by the City Clerk's Office until
noon on Friday, September 19, 2014.
Ten (10) applications were received by the City Clerk's Office and are attached hereto as Attachment A.
Appointment Process
Pursuant to City Council Policy A -2, appointments to the City Arts Commission will take place in the
following manner:
A. The City Council will vote on all appointments simultaneously. The voting will be done by paper ballot
and the City Clerk will tabulate and announce the results, including the vote tally.
B. Each member of the City Council will cast one vote on the paper ballot. In order to be appointed, an
applicant must receive at least four votes.
ENVIRONMENTAL REVIEW:
This action is not subject to the California Environmental Quality Act ( "CEQX) pursuant to Sections 15060
(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in
physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at
which the City Council considers the item).

To whom it may concern,
I have been involved with the arts since I can remember. As a child, I performed in our local community theatre, in college I worked in our
costume shop. As an adult, my life revolves around the arts. My passion is supporting "all things live and local ". As a board member(and
actor and producer) of a local community theatre, I have been able to experience first hand what it takes to bring a show to life. Newport
Beach has a wealth of opportunities with both fine and performing arts. I have also worked for many years on the fund raising side for
several different organizations. This has been an invaluable experience. I realize the challenges that most artistic organizations face
today. It no longer enough just to fill a seat or pay an admission. There is so much more to keeping the arts alive -from applying for
grants to publicity, selling tickets and fund raising. All of these components have a very important place within organizations. I would to

My grandfather, Lyell Loomis Buttermore, first began painting watercolors alongside Rex Brandt some 65 years ago as a CdM resident.
With the exception of being away at school, I am pleased to say that Newport Beach has been home to both sides of my family for over
three (3) generations. I first picked up a Super 8 camera when the ear doctor told me I couldn't go in the ocean anymore to surf. When
my friends who surfed and snowboarded became sponsored, I followed with a camera. This took me around the world as both a
photographer and cinematographer for VOLCOM for more than 7 years. I've also been fortunate to work with three Academy Award
nominated film directors such as Greg MacGillivray, Bailey Sileck, Darren Aronofsky who directed "BLACK SWAN" and "NOAH" as well as
Newport's own McG. My transition from film to architecture began in my twenties while acquiring my first master's degree as a means to
serve the family legacy which my Popop began many years ago. I had an amazing ten year run editing movies and directing music
videos & commercials but in my humble opinion, there is nothing like building a building. I completed my 2nd masters (in architecture)
a full year early whereas today, I am 34 and am priveleged to serve as a design consultant for many of the top firms here in the city. Just
last month, I finished the updated facade design for the Laguna Beach Festival of the Arts on behalf of Bauer Architects which begins
construction this fall immediatley after the Pageant of the Masters. I am applying to volunteer for the city which serves as my home as I
have truly enjoyed doing so for Santa Ana's Public Art Commitee, I enjoy the comradery and I enjoy helping with matters which I work in
daily. I also would like to give back to the city which has provided me with so much. I am a firm believer in art as a vehicle to inspire,
particularly the youth of this city which we call home. Thank you for your time and consideration.

In college I ran the University Center's Art Gallery and was a member of the student council. I have alway had an interest In art, design
and aesthetics. I am so impressed with our city and how h keeps evolving and would love to be able to contribute in some way. I like
the new City Hall and open space areas and find the art surrounding it very interesting. My background as a tv commercial and photo
shoot producer, I feel, would make me an ideal candidate. I am efficient, I can manage a budget, I'm organized, I was extremely
Involved in the creative process and am great with a task.
I know there is not a lot of community involvment or volunteer activities on my application. Fortunately or unfortunately I have worked
full time since I have graduated from college. My career has been all encompassing and included much travel that I was unable to
volunteer regularly In any capacity other than Girl Scout Leader for both my daughters'troops. About 1 year ago I left my career in order
to spend more time with my children as they got older as well as become more involved in my community.

I feel a tremendous Civic pride in the City of Newport Beach. My children had the benefit of a top quality education in the
Newport Mesa School District. And as an active volunteer within the community over the last 14 years, I embrace the philosophy
that it takes a village to raise a child.
Now that my two sons are heading off to Stanford and Cal Poly San Luis Obisbo in the fall, my energy and enthusiasm can be
delegated to areas which I am quite passionate. I am a fifth generation Californian and believe in honoring this legacy and
pioneering spirit of my ancestors. And a legacy based on the promotion of the arts engenders a world class cultural
environment. And I believe that I can serve my community to deepen a love for the arts.
My parents first met in Newport Beach almost 60 years ago and knowing the Pavilion Building is still a cherished landmark is an
indication of the city's commitment to tradition. As well as Newport Harbor High's reconstruction efforts to maintain the integrity of
the original Clock tower.
My personal mission statement written over 16 years ago "synergistically create a lasting legacy for my family and my
community"

I am interested in serving on the Newport Beach Arts Commission for several reasons.
I have a passion for all aspects of the arts and feel that our community greatly benfits from the cultural enrichment that this Arts
Commission supports. Over the years I have been involved with numerous volunteer programs that have encouraged community
involvement, creativity, fund raising and good old fashioned family fun.
I have lived in Newport Beach since 1964. My father is a founding professor of UCI, Dr. James McGaugh. We are a family that believes in
giving back to the community. My educational background, work and volunteer experience, passion for all aspects of the arts and love
of Newport Beach should be a perfect match for this position.
In August we sent our youngest of four kids off to college.
I am now interested in volunteering my time with the city of Newport Beach on The Newport Beach Arts Commission.
Newport Beach is our home, maintining a wonderful sense of community through culture and the arts is very important to me.

I love living in Newport Beach. We've had property here for 20 years, but have only lived here full time for 3 years. I recently retired from
teaching and am anxious to get involved in our community.
My husband and I try to take advantage of the multitude of arts - related options in our city and the surrounding ones. We enjoy concerts
(classical, jazz, popular, folk, etc.), theater (musicals, plays, film, dance, and other performances), art exhibits and shows, and all the
beautiful public facilities we have in our city. We have actively enjoyed arts in all of the Southern California and East Coast communities
in which we have lived.
I also spent many years supporting the arts through providing direct work: logistics, marketing, fund - raising, and backstage work for
many years when our now -adult daughter was actively performing with school, church, and community organizations.

Summarize why you wish to serve the City of Newport Beach on a board, commission or committee. Include any special qualifications
you have which are particularly appropriate to the position for which you are applying.
As a life -long resident and a homeowner in Newport Beach, I would like to get more involved in our City by serving on the Arts
Commission. I have worked for both the County of Orange and the State of California and have seen firsthand how the community is
affected by the decisions made by our government. By understanding how good governance can make our City stronger, I will work on
the Arts Commission to help Newport Beach become a better environment for our citizens and their families. The Arts Commission is
uniquely situated to work with the City Council, staff and community members to improve the physical appearance of our community
through art. Residents desire a sophisticated, educated and intellectually engaging atmosphere within our City. Bringing more culture
and civic awareness to our City is essential to our well- being, and to maintain and improve property values, a fact that was embraced by
the City Council with their recent focus on public art.
I have experience working with all levels of government, businesses (both large and small), non - profits and community /civic leaders and
have extensive contacts with them all. Additionally, I have worked for, and with, elected officials who have represented constituencies
greater than 500,000 people. This has taught me how to interact and work with people whom may disagree with you philosophically but
can come to the consensus that the common goal is greater than our differences. I will bring my many years of experience, a positive
attitude and a real desire to continue to improve our City to the Arts Commission.
