SUBJECT: LEGAL ADVERTISING BID FOR FISCAL YEAR 1999 -2000
Recommendation
Accept the bid of the Daily Pilot and authorize a purchase order for the one -year period of fiscal
year 1999 -2000.
Background
Publication of the City's legal notices in a newspaper of general circulation is required by law.
During the last nine fiscal years the Daily Pilot has performed this function for the City.
Notices inviting bids for a one -year period were sent to the Daily Pilot, Newport Beach Light,
Orange County Register, Newport News, and the Los Angeles Times. Bids were received from
the Daily Pilot and the Newport Beach Light. The Newport News submitted a bid after the
deadline (4:00 p.m., July 11, 1999), therefore it was rejected and returned unopened. The
breakdown of the two bids submitted is as follows:
Daily Pilot
$9.50 per column inch, per insertion
Published Monday — Saturday
Deadline — 5:00 p.m., two days prior
Number of paid subscriptions — 13,799
Copies distributed/mailed — 28,299
Newport Beach Light
$7.00 per column inch, per insertion
Published once a week — Thursday
Deadline — 10:30 a.m., Friday
Number of paid subscriptions — 8,597
Copies distributed/mailed — 25,818
Even though the Newport Beach Light submitted the low bid, I feel it is in the best interest of the
City to award the contract to the Daily Pilot since they have a higher circulation and publish
Monday — Saturday. Using a newspaper that publishes daily allows the City more flexibility in
meeting our legal noticing requirements. In general, most of the City's public hearing notices
require publishing ten (10) days prior to the hearing date. Utilizing the Newport Beach Light's
deadline for submitting copy for a new ad, the ad must reach them by 10:30 a.m. on the Friday
before their Thursday publication date. The Daily Pilot requires that ad copy be submitted to •
them by 5:00 p.m. on Wednesday for a Friday publication date. As an example, all legal public
hearing notices for this meeting (June 28`h) would have needed to be submitted to the Newport
Beach Light by 10:30 a.m. on Friday, June 11`h for a publication date of Thursday, June IT , in
order to comply with our ten -day noticing requirement. Using the same scenario to publish in the
Daily Pilot our ad copy would have needed to be submitted to them by 5:00 p.m. on Wednesday,
June 160h for a publication date of Friday, June 18`h. In addition, the Daily Pilot has always
accepted late or emergency type ads on very short notice.
I feel that the very restrictive deadline for submitting ad copy to the Newport Beach Light will
result in either delaying projects for two weeks, or force us to publish in the Daily Pilot using
their open rate of $13.00 per column inch, per insertion.
The Daily Pilot will continue to abide by all agreements previously made as far as
complimentary copies, pick -up service for all advertising needs, accepting emergency copy
insertions to meet legal requirements, and publishing the Council agenda summary at no charge.
