SUBJECT: "TASTE OF NEWPORT" BANNERS
RECOMMENDATION:
1. Approve the request of Newport Harbor Area Chamber of Commerce for the
installation of 202 banners, from August 25, 1999 to September 20, 1999.
Installation shall be along Jamboree Road, MacArthur Boulevard, Dover Drive,
Westcliff Drive, Balboa Boulevard, Newport Boulevard, and Newport Center Drive
East/West.
2. Deny the request.
0 DISCUSSION:
Newport Harbor Area Chamber of Commerce ( NHACC) has requested that 202 private
banners be installed from August 25, 1999, through September 20, 1999, in the
Fashion Island area for the 11th Annual "Taste of Newport". The banners will be
mounted on street light poles along Jamboree Road (10 banners), Newport Center
Drive East/West (126 banners), Dover Drive (5 banners), Westcliff Drive (6 banners),
Balboa Boulevard (8 banners), Newport Boulevard (3 banners), and MacArthur
Boulevard (44 banners) public right -of -way (see attached Exhibit).
On the weekend of September 17- 19, 1999, NHACC will host the 11th Annual "Taste of
Newport" — a dining and entertainment celebration highlighting the many restaurants in
Newport Beach. The Chamber reports that about 50,000 people attend the "Taste of
Newport" events. Attendees will pay a $9 admission charge to enter the event and will,
if interested, purchase scrip to receive food and drink from participating restaurants and
caterers.
For nine consecutive years the Costa Mesa based "Times Orange County" is the co-
sponsor and underwriter of "Taste of Newport". To recognize the newspapers role, the
Chamber has designed a 2' by 7' banner that includes the 'Times" logo on the top of
the banner.

On Wednesday, August 11, 1999, NHACC president Richard Luehrs asked the City to •
allow the Chamber to install the banners on City light poles between the period of
August 25, 1999, and ending on September 20, 1999.
The event is not co- sponsored by the City of Newport Beach, not organized by a non-
profit organization, not free to the public, and does not exclude advertisement of the
sponsor (Times) as required per City Council Policy L -16. Council Policy L -16 prohibits
the use of a commercial sponsor's name on the banner. Staff notes that this sponsor is
a commercial newspaper. However, the event will be community -wide, open to the
public, and may create additional revenue to the City through restaurants, businesses,
and hotel reservations.
The applicant's request to install 202 private banners will exceed the 100 banner limit
and the single banner per pole concept allowed per City Council Policy L -16. In the
past, the following similar requests have been approved by City Council: "Taste of
Newport" (approved July 13, 1998) and Orange County Museum of Art (approved
October 12, 1998).
There have been no reported public complaints, but in the past two years there have
been mechanical problems with some of the private Orange County Museum of Art
banner brackets and damage to the street light poles as a result of strong winds. Some
of the damaged street light poles show evidence of rust damage from deterioration
and /or vehicle damage. Wind slit openings on the banners can ease the load during •
windy conditions.
Should the City Council elect to approve the installation of 202 private banners in the
Fashion Island area for 27 days, staff recommends the following conditions of approval:
1. No banners shall be installed on traffic signal poles.
2. On Newport Center Drive (from East Coast Highway) and Newport Center Drive
EastlWest (Ring Road) the locations shall be limited to the center median. Two
banners will be installed per each pole.
3. The applicant must provide on -going maintenance of the banners and brackets.
4. The applicant must sign a "Hold Harmless Statement" requiring maintenance of the
banners /brackets and indemnification and hold harmless for any liability associated
with the banners /brackets.
5. The applicant must maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better, and a financial
size category of "VIII" or higher.
6. Issuance of an Encroachment Permit by the Public Works Department. 0

7. The banners shall conform to City Council Policy L -16 with the exception of the
number of banners, advertisement of sponsor, open to the public free of charge,
and co- sponsor by the City.
8. All banners and brackets shall be removed by the end of the approved time unless
otherwise approved by the conditions stated in the Encroachment Permit.
9. All banners and brackets shall comply with the Encroachment Permit conditions.
10.If needed, the City may require removal of some of the banners to allow other
organizations to install banners at the same location and during the same time
period.
11.A minimum of two 5" wide half - circle wind slits per banner are required to minimize
the wind load.
12.The printed font of the sponsor, "Times ", shall be the same size or smaller than the
"Taste of Newport".
