PROGRAM GRANT APPLICATION FOR
BOULEVARD STREETSCAPE (BONITA
PARK/FREEWAY RESERVATION SITE)
RECOMMENDATION:
MITIGATION (EEM)
THE MACARTHUR

Adopt Resolution No. 99 - approving the submittal of an Environmental
Enhancement and Mitigation (EEM) Program Grant Application to the Resources
Agency of California for the MacArthur Boulevard Streetscape (a portion of Bonita
Canyon Sports Park) and designating The Public Works Director as agent for the City in
submitting the application administering the project.

DISCUSSION:
The EEM Program was established by the enactment of the Transportation Blueprint
Legislation of 1989 (AB471, Katz). This legislation allocated $10 million annually for
this program for grant purposes for a 10 -year period from FY 1991 -1992 to FY 2000-
2001. Any federal, state or local agency may apply for and receive grants. Grants for
individual projects are generally limited to $250,000. The grant application guidelines
require that a City representataive be designated in the resolution as the City's agent to
sign the application and administer the project. It is recommended that the Public
Works Director be designated as the City's agent.
Staff has prepared and submitted an application package for the MacArthur Boulevard
Streetscape, which is part of Bonita Canyon Sports Park, currently under design. The
grant application is for the graded slope adjacent to the east side of MacArthur
Boulevard southerly of Bonita Canyon Drive. A grant of $250,000 is being requested.
Staff recommends that the City Council approve the application for EEM funding as
follows:

Please note the City's FY 1999 -2000 Capital Improvement Program includes a is
budgeted amount of $5,912,000 for the design and construction of Bonita Canyon
Sports Park.
The grant application was submitted on November 15, 1999. The attached resolution
must also be submitted for the project to be eligible for consideration.

RESOLUTION NO. 99 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING THE APPLICATION OF
GRANT FUNDS FOR THE ENVIRONMENTAL
ENHANCEMENT AND MITIGATION PROGRAM UNDER
SECTION 164.56 OF THE STREETS AND HIGHWAYS
CODE FOR THE FOLLOWING PROJECT:
MACARTHUR BOULEVARD STREETSCAPE
(BONITA CANYON SPORTS PARK/FREEWAY RESERVATION SITE)
WHEREAS, the Legislature of the State of California has enacted AB 471
(Chapter 106 of the Statutes of 1989), which is intended to provide $10 million annually
for a period of 10 years for grant funds to local, state and federal agencies and nonprofit
entities for projects to enhance and mitigate the environmental impacts of modified or
new public transportation facilities; and
WHEREAS, the Resources Agency has established the procedures and
criteria for reviewing grant proposals and is required to submit to the California
Transportation Commission a list of recommended projects from which the grant
recipients will be selected; and
WHEREAS, said procedures and criteria established by the Resources
Agency require a resolution certifying the approval of application by the applicant's
governing body before submission of said application to the State: and
WHEREAS, the application contains assurances that the applicant must
comply with; and
WHEREAS, the applicant, if selected, will enter into an agreement with the
State of California to carry out the environmental enhancement and mitigation project.
NOW, THEREFORE, be it resolved that the City Council of the City of
Newport Beach,
1. Approves the filing of an application for the Environmental Enhancement and
Mitigation Program for grant assistance.
2. Certifies that said applicant would make adequate provisions for operation and
maintenance of the project.
3. Appoints the Public Works Director as agent of the City of Newport Beach to
conduct all negotiations, execute and submit all
documents, including,
but
not
limited to applications, agreements, amendments,
payment requests and
so
on,
which may be necessary for the completion of the aforementioned project.
