Temple (949) 644 -3228 ACTION: Adopt Resolution No. 99 -_, extending the tenure of the Ad Hoc Harbor Committee On January 11, 1999, the City Council adopted Resolution No. 99 -2, establishing the Harbor Committee, a citizen's ad hoc advisory committee. That Resolution sets forth the composition and duties of the Committee, and also set a termination date for the Committee at December 31, 1999. A copy of this resolution and related staff report is attached for the information of the City Council. The Committee has been very active over the past year, meeting twice a month. They have worked in sub - committees, and have produced a draft Harbor Element, which is proposed to be adopted into the City's General Plan. However, the Committee is still working on the final language and proposed policies, and believes that three additional months will be needed to complete the document and deliver it to the City Council. Should the City Council wish to authorize this Committee for an additional three months tenure, the attached Resolution should be adopted. Submitted by: SHARON Z. WOOD Assistant City Manager 1. TEMPLE Planning Director RESOLUTION NO. 99- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING THE AD HOC HARBOR COMMITTEE. WHEREAS, Newport Harbor is the major element establishing the unique attractiveness of Newport Beach; and WHEREAS, the City Council wishes to maintain now, and in the future, the recreational and scenic qualities of Newport Harbor and assure that its operations do not impact the unique attractiveness of Newport Harbor; and WHEREAS, the City Council deems it desirable to appoint an Advisory Committee to the City Council to make recommendations on any matter pertaining to the operations of Newport Harbor. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that: 1. The Ad Hoc Harbor Committee is created, and the membership, term and duties of the Committee shall be as follows: A. Membership: The Committee shall consist of thirteen (13) private citizens, nominated by the Mayor and confirmed by the City Council. The Fire and Marine Chief, assigned members of the Planning Department, and the Assistant to the City Manager shall provide staff assistance to the Committee. B. Officers: The Committee shall have a chair and vice - chair, each of whom will be selected by the Committee. C. Meeting Times: The Committee shall meet once a month or as determined by the Committee. 0 0 ti 0 L D. Term: The term of each private citizen member of the Committee shall be from January 151 to December 31s', provided, however, the term of those citizens first appointed to the Committee shall continue from date of appointment through to December 31, 1999. The term of each private citizen member of the Committee may be renewed at the pleasure of the City Council upon the recommendation of the appointing member. E. Termination: The Committee shall terminate in one year. In October 1999, the City Council shall review the activities of the Committee and determine if any changes should be made to the terms of this Resolution. F. Duties /Purpose: The Committee shall act as the advisor to the City Council on harbor issues as required. The Committee shall review all harbor operations including, but not limited to, recreational, commercial and educational uses, harbor maintenance, as well as short and long term strategic planning. Prior to its termination the Committee shall prepare a report to the City Council with recommendations for current and future policy guidelines in these areas. The Committee is empowered to submit recommendations to the City Council on methods and ways of educating the boating industry, the public, and impacted groups on issues effecting harbor operations. Item 6 TO: Mayor and Members of the City Council FROM: Tim Riley, Fire and Marine Chief SUBJECT: The Harbor Committee, a Citizen's Advisory Ad Hoc Committee RECOMMENDATION: If desired adopt Resolution No. 99 -_, approving the creation of the Harbor Committee, an Ad Hoc Committee, for a term of one year. BACKGROUND: In March of 1998, the Harbor Quality Committee created a subcommittee called "The Harbor Review Task Force" as a result of input from concerned citizens regarding harbor issues they felt were not being addressed by the City. The initial goals of this committee were to identify those governmental agencies that had an impact on harbor related issues, discuss citizen concerns relative to harbor uses, and to make recommendations to the Harbor Quality Committee for changes where appropriate. . Those recommendations included, but were not limited to, issues of bay access, commercial, recreational and educational use of the harbor, business serving uses within the harbor, fee equity for harbor users, management of harbor issues, and strategic planning for the future. The subcommittee was also to review the processes used by local government to obtain public input and local government's responses to requests for information on harbor related issues. Once the Harbor Review Task Force began to meet, it became apparent that there was a need, not only for consideration of those issues listed above, but for some direct input to the City Council on medium and long term planning for the Harbor's future. It was felt that this was of such importance that instead of going through the Harbor Quality Committee, a special committee should be established that could report directly to the City Council. To obtain the necessary citizen input on these issues it was felt that the committee should be comprised of 13 members that represent the following interests: 1. Charter vessel operators 2. Marina owners and operators 3. Waterfront homeowners 4. Recreational boaters 5. Commercial fishing 6. Yacht clubs 7. Mooring owners 8. Waterfront businesses 9. Harbor Quality Committee 10. Marine construction 11. Shipyard interests 12. Waterfront instructional and non - profitable organizations 13. Sport fishing The committee would meet for one year to study those issues listed above. During that time, if requested by the City Council, they could make recommendations based upon specific requests. At the end of the one -year period the committee will prepare a report to the City Council with recommendations for policy guidelines in these areas. These recommendations could be utilized in the City's General Plan review. The committee would have assigned to it appropriate staff members to include but not limited to the Fire and Marine Chief, the Assistant to the City Manager, and representatives assigned from the Planning Department. • . RESOLUTION NO. 99- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH EXTENDING THE TENURE OF THE AD HOC HARBOR COMMITTEE. WHEREAS, Newport Harbor is the major element establishing the unique attractiveness of Newport Beach; and WHEREAS, the City Council wishes to maintain now and in the future the recreational and scenic qualities of Newport Harbor and assure that its operations do not impact the unique attractiveness of Newport Harbor; and WHEREAS, the City Council appointed an Advisory Committee to the City Council to make recommendations on matters pertaining to the operations of Newport Harbor; and WHEREAS, the Advisory Committee was scheduled to sunset on December 31, 1999; and • WHEREAS, the City Council deems it desirable to extend the tenure of the Advisory Committee until March 31, 2000, in order to complete their deliberations and recommendations. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that the Harbor Committee established by Resolution 99 -2 is extended until March 31, 2000.
