HomeMy WebLinkAbout13 - Additional Curb at 4309 Seashore Drive• December 13, 1999 CITY COUNCIL AGENDA ITEM NO. 13 TO: Mayor And Members Of The City Council FROM: Public Works Department SUBJECT: APPLICATION BY ROBERT FREED TO CONSTRUCT AN ADDITIONAL CURB CUT AT 4309 SEASHORE DRIVE IN WEST NEWPORT RECOMMENDATION: Approve application for an Encroachment Permit to construct a curb cut. DISCUSSION: Robert Freed, owner of 4309 Seashore Drive, Unit #A, requests approval of an • encroachment permit for the construction of an additional curb cut along the Seashore Drive frontage. The proposed curb cut is needed to provide reasonable parking access to an existing garage structure that serves a two -unit condominium (see attached letter dated December 1, 1999). The two -unit condominium is served by a three -car, subterranean parking structure with a two -car garage door access into a three -car garage. The configuration causes access problems between the two property owners when Unit #B's cars block Unit #A's car. The structure is located on the beach side of Seashore Drive where most property frontages are garages. The construction of an additional curb cut will allow direct access to the third parking space utilized by the owner of Unit #A, and will exceed 50% of the property frontage in drive approach. The construction of the new drive approach will eliminate one on- street parking space. City Council Policy L -2 requires that curb cuts not exceed 50% of the property frontage unless otherwise approved by the City Council. The proposed curb cut is acceptable to the Traffic Engineer because the parking space to be eliminated is adjacent to the bike path and parked vehicles often encroach into the bike path. Staff feels there will be little impact to on- street parking as only one unmetered public parking space will be lost, and this loss will be partially offset by ensuring access to the off - street space. 0 SUBJECT: Application of Robert Freed to Construct an Additional Curb Cut at 4309 Seashore Drive in West Newport Decenber 13, 1999 Page 2 Staff recommends that the following conditions apply should City Council approve the • proposed additional curb cut: 1. The design of the driveway and building modifications shall meet all the requirements of the Planning, Building and Public Works Departments. 2. The grade along the property line shall not be lowered. 3. The applicant shall execute a hold harmless agreement with the City, protecting the City from claims due to storm water entering the garage from the new driveway. Ease of entering and exiting garage space owned. 2. Access into garage is so tight we have damaged the side of our two cats not once but twice. We tried to place a foam pad on the steel column and the block wall comer for protection. 3. This is a 2 -unit building. The second unit is owned by others and always rented. The occupants autos make it difficult for us to get into our space, sometimes we have to get out of our car and go to the door and ask them to move (if there home), so we can squeeze into our space. 4. The existing drive transition is so steep we scrape the bottom of our cats no matter what angle or approach we take. Tires spin at times. 5. This has become a hardship to us and hope you understand our situation.
