SUBJECT: APPOINTMENT OF OFFICERS TO CITIZENS ADVISORY COMMITTEES
AND THE AVIATION COMMITTEE
RECOMMENDATION
Discuss and provide direction to staff.
At the City Council meeting of December 13,1999, Mayor Noyes requested that the City Council
decide at its meeting of January 11, 2000, if the Mayor should have the authority to make the
appointments of chairman and vice chairman for both the Harbor Quality Citizens Affairs and
Aviation committees, and if the citizen committees should have a citizen or a council member as
the chairman and vice chairman.
The Harbor Quality Citizens Advisory Committee was established by Resolution No. 86 -59,
adopted on July 14, 1986. Section I.B. of the resolution states that the Committee shall have a
chair and vice - chairman, each of which is to be appointed by the Mayor. Resolution No. 86 -59
was amended on June 28, 1999, however the make -up of the committee and the method in which
the chairman and vice - chairman are appointed was not changed. Resolution No. 9597 adopted
on July 10, 1979 establishing the Aviation Committee nor any of the resolutions amending it
subsequent to that date address the method for the appointment of the chairman. On February 9,
1998 the membership composition and duties were changed by the adoption of Resolution No.
98 -15, however the resolution did not address the appointment of officers.
At the December 13`h meeting, Mayor Noyes also mentioned the possibility of restructuring the
committees to provide more uniformity amongst them. The Harbor Quality Citizens Advisory
Committee and the Environmental Quality Affairs Citizens Advisory Committee are both
categorized as "citizens advisory committees ". By resolution the members of both committees
are private citizens nominated by each member of the City Council with the nominations
confirmed by the full Council. The Mayor appoints two Council Members to serve on each
committee. The Mayor appoints the chairman to the Environmental Quality Citizens Advisory
Committee, however the vice - chairman is elected by the Committee. As mentioned previously,
according to the enacting resolution, the Mayor appoints the chairman and vice - chairman to the i
Harbor Quality Citizens Advisory Committee. On December 13, 1999 Mayor Noyes appointed
Earl McDaniel as the chairman to the Environmental Quality Affairs Citizens Advisory
Committee, however he did not appoint the chairman and vice chairman to the Harbor Quality
Citizens Affairs Committee because he did not believe he had the authority to do so.
The Aviation Committee is categorized as a "City Council /Citizens Ad Hoc Committee ". The
committee membership is comprised of two members of City Council appointed by the Mayor
and one appointee and one alternate from each of the seven councilmanic districts appointed by
the City Council Member. The current president or designee of the Airport Working Group is
also a member, as well as the City Manager and City Attorney (or their designees). According to
staff who worked with this group, it appears that historically the chairman has always been a
Council Member, even though the resolution does not specify how the officers are appointed.
ALTERNATIVES
1) Determine that pursuant to the enacting resolution for the Harbor Quality Citizens
Advisory Committee, the Mayor has the authority to appoint the chairman and vice -
chairman, therefore direct staff to place these appointments on the January 25, 2000
agenda.
2) Direct staff to prepare resolutions to be considered at the January 25, 2000 meeting which .
changes the method in which the chairman and vice chairman are appointed to the Harbor
Quality Citizens Advisory Committee and the Environmental Quality Affairs Citizens
Advisory Committee, and/or a resolution .which establishes the method in which the
chairman is selected for the Aviation Committee.
