Recommendation
Approve the donation of a child's play unit to Orange Coast College.
Background.
On October 18, 1999, General Services Department staff notified the property owner at 4711
Seashore Drive of a nuisance violation. The notice of violation was sent in response to the
illegal encroachment of play equipment, specifically a child's play unit, on the public beach.
A second notice was sent on November 1, 1999. Staff did not receive a response from the
property owner to either of the two notices. On November 10, 1999, staff impounded the
equipment, which is now stored at the City Corporation Yard. To date, the City has not received
any response nor inquiry regarding the impounding of the equipment.
In February, a representative from Orange Coast College informed staff of their interest in
obtaining the play equipment for use at the Harry & Grace Steele Children's Center located on
the College campus. The attached letter from the College Child Care Manager confirms the
College interest in the equipment. (Attachment A).
Discussion
The play equipment was declared a nuisance on public property per Section 10.50.020(f) of the
municipal code. Following the property owner's failure to respond to the notices of violation,
City staff impounded the equipment to avoid any City liability that may be associated with use of
the equipment by beach patrons.
The equipment is used and the value is estimated at less than $100. The City would be best
served by the proposed donation to an educational institution such as the Children's Center at
Orange Coast College.
Per Council Policy F -11, donations made by the City must be approved by the Council and
whenever possible, local charities and homeowners associations will be given first choice. This
current donation request is consistent with Council policy.

Dear Mr. Niederhaus;
It has been brought to my attention that the city of Newport Beach has a Little
Tike Castle Climber that was left on the beach. The Harry At Grace Steele
Children's Center at Orange Coast College is interested in the climber if it is
available. We have a toddler program with a large outdoor sand area that would
easily accommodate the structure and believe the children would greatly benefit
from having a small climber.
Please let me know if the climber is still available and if you would consider our
