SUBJECT: Dolin Residence Retaining Wall
1541 Dolphin Terrace
SUMMARY: Request to permit the construction of a retaining walls and decks that will
exceed the permitted 6 foot height limit in the side and rear yard setback
areas. The proposed retaining walls are intended to stabilize an unsafe slope
and reclaim 29 feet of rear yard previously slope that was lost due to
erosion. The retaining walls range in height from 4 feet to 8 feet 6 inches in
height for the lower wall and 8 to 12 feet in height for the second retaining
wall.

ITEM NO. 2.
SUBJECT: Big Belly Deli
6310 West Coast Highway
SUMMARY: A request to convert an existing 1,500 square foot retail building into a full -
service, small -scale eating establishment (pizza/deli) with 24 seats, that
includes a waiver of the off - street parking requirements, and to establish a
new alcoholic beverage service outlet pursuant to Chapter 20.89 of the
Municipal Code.
REQUIRED Hold public hearing;
ACTION: Approve, modify or deny:

ITEM NO. 3.
SUBJECT: Annexation of Bay Knolls and Newport Coast/Ridge Areas
SUMMARY: General Plan Amendments, LCP Amendment, Prezoning Amendments,
sphere of influence changes, detachments, and annexations necessary to
complete annexation of the Bay Knolls and Newport Coast/Ridge areas to
the City.
ACTION: (1) Open the public hearing and continue the Bay Knolls portion of the
prezoning and annexation "package" to April 13, 2000. (2) Table review
of the Newport Coast/Ridge portion, pending completion of the joint
powers agreement with the County regarding administration of
development entitlements for the area.
ITEM NO. 4.
SUBJECT: Newport Dunes Resort (Newport Dunes Partnership, applicant)
SUMMARY: A General Plan Amendment, Local Coastal Program Land Use Plan
Amendment, Zoning Code Amendment, and Planned Community District
Plan for the 100 -acre Newport Dunes property and a conceptual precise
plan for a hotel and time -share complex with conference, meeting, and
banquet facilities, restaurants, a health club and spa, retail and services
areas, and swimming pools and landscaped garden areas.
ACTION: Conduct public hearing; continue hearing to April 13, 2000.

SUMMARY: Report of the actions of the Planning Commission
Item I regarding 1541 Dolphin Terrace (Modification No. 4968 and Acceptance of a Negative Declaration)
was approved and is subject to appeal or call up by the City Council. (5 ayes, l absent)
Item 2 regarding 6310 West Coast Highway (Use Permit 3666) was approved and is subject to appeal or
call up by the City Council. (5 ayes, 1 absent)
Item 3 regarding Annexation of Bay Knolls and Newport Coast/Ridge Areas was separated. The Bay
Knolls Annexation was continued to April 13th and the Newport Coast/Ridge Areas was tabled pending a
review of the completion of the joint powers agreement with the County regarding administration of
development entitlements for the area. (5 ayes, l absent)
Item 4 regarding 101 North Bayside Drive and 1131 Back Bay Drive (applications regarding Newport
Dunes development) was continued to April 20, 2000. (5 ayes, 1 absent)
