Informational report only. Background City Council Agenda Item No. 16 April 25, 2000 Each City street has at least one designated tree species. The purpose of the designation is to promote uniformity of the street treescapes throughout the City. The City Street Tree Designation List is maintained and reviewed on an annual basis by City staff. Any changes, recommendations, or resident's requests for changes are forwarded to the Parks, Beaches, and Recreation Commission per Council Policy G -6. The current list is attached. The list was extensively revised over a 4 -month review period that included several public review sessions conducted by the Tree Subcommittee of the PB &R Commission. All homeowner associations (120) were directly contacted for their recommendations. A total of 10 recommendations were received and acted upon by the Tree Subcommittee. The attached PB &R Commission agenda item of March 7, 2000 provides further background information. The PB &R Commission adopted the list at their March 7, 2000 meeting as per Council Policy G -6. Council review of the Commission adoption action is not required, but may be undertaken if necessary. There is no time limit for Council action. A copy of the PB &R Commission meeting minutes is attached. 1:\ Unm\ GSWNLindeman\2000\Apriloo\CitySh tTr« DesListCCAg \StTmeDesignadonCCAg.dw Discussion As noted earlier, numerous changes were made to the list to meet the criteria developed by the PB &R Commission Tree Subcommittee and staff. Many of the tree designations were changed as a means of modernizing the City treescapes with more ornamental, non - deciduous, vector -free, and adaptable; species. Because the original list was over 15 years old and was incomplete in regards to tree species, the new list appears to be more of a major revision than it actually is. The new list contains 85 different tree species, an increase of 42% over the old list, where only 60 species were noted. Many undesirable tree species have been eliminated for various reasons such as hardscape damage, untreatable tree disease, and climate tolerance. Some of the concerns with such an extensive change in tree designations is that there will be a rapid change to the City treescapes, numerous reforestation requests (removal and replacement) as residents are attracted to the newly offered ornamental trees, and a lack of uniformity as the new tree species replace the current trees. Staff does not anticipate these effects other than a gradual change over many years. An average of 200 trees are removed and replaced on an annual basis by staff each year, a very small percentage of the City tree population (30,000). Most of the removals are related to disease, storm damage, or City reforestation projects. This number is not expected to increase dramatically due to changes to the tree list. A particular street tree designation may be changed by the submittal of a petition of the majority of residents on a particular street to the PB &R Commission for consideration. Unless the tree species requested is an undesirable street tree or conflicts with the majority of trees already planted on the street, the petition generally receives a favorable decision. History The current list was compiled more than 10 years ago using arboricultural information available at that time. The list is now outdated in light of several factors; the introduction of new species, established problematic history of certain City trees, and an awareness and availability of new arboricultural techniques. Revisions to the attached list have been developed in collaboration with staff, the City tree contractor (West Coast Arborists) and the Tree Sub - Committee of the Parks, Beaches, and Recreation Commission (PB &R) (Attachment A). Additionally, two public meetings were held to solicit comments from interested property owners. Staff mailed 180 notices advising of the two public meetings held in September and advertisements were made in the local newspaper, and on the local cable television channel. The trees recommended for the list meet the following criteria: ♦ Trees with aesthetic appeal that visually integrate well with the characteristics of existing street trees. ♦ Trees with good resistance to disease and pests. ♦ Trees with good soil and climate adaptability. ♦ Trees that do not damage hardscape. ♦ Trees that are suited to certain growth spaces. The proposed list is meant to provide a concise, self - contained reference of approved street trees for use in public right -of ways in the City of Newport Beach. The finished product is to be user friendly for private property owners as well as commercial property owners, contractors, landscape architects, and City staff. Discussion The proposed list was submitted to the Commission at the November 2, 1999 meeting. A public hearing was held on the matter and the Commission directed staff to mail the list to all homeowners associations so that additional review and input could be made. The attached letter dated November 29, 1999 was sent to 120 homeowner associations and 60 individual interested parties. Seven responses were received with comments, questions, and suggestions. The Tree Sub - Committee of the PB &R met on January 17, 2000 to discuss the proposed changes and incorporated most of the changes into the attached new proposed document. Additionally, letters were sent by staff as a follow up to those associations and individuals who gave input at the January 17 meeting. The attached letter from the Balboa Peninsula Point Association is requesting additional changes to the list that staff concurs with, except for the request to retain the Carrot Wood trees as a designated selected tree (Attachment B). Staffs experience is that Carrot Wood trees have become a liability due to invasive root systems. Therefore, staff recommends that the listed proposed tree species remain, for Channel Rd, Pittosporum phillyraeoides (Willow Pittosporum), and for Ocean Blvd., Metrasideros excelsus (New Zealand Christmas Tree). West Newport Park Playground Renovation – Senior Recreation Manager McGuire stated that both playground areas are ready to be replaced. In accordance with ADA standards they need must be age specific; drawings were displayed. She also stated that the lexan panels would be replaced with FY 2000/01 CIP funds. Commissioner Skoro asked whether there would be signage regarding the appropriate age for use of the play equipment. Manager McGuire noted that she would investigate the matter. Chair Beek opened the public hearing Walter Semeniuk, 6807 W. Seashore Drive, stated that he lives right across the street from the park and that he had two concerns, (1) more handicapped parking was needed, and (2) that speed bumps should be installed on Seashore Drive to slow up traffic. Director Niederhaus stated that CalTrans was responsible for that road and would not allow speed bumps, he suggested that Mr. Semeniuk write a letter to the City regarding his concerns for speed bumps. David Granoff, 7308 W. Oceanfront, noted that he was happy that some changes were going to be made to the park but was concerned that the park for the younger children would be near the public restrooms. Manager McGuire noted that the play equipment could be put together, but that by law they must be separated by a specific amount of space. If that were done, than swings could not be accommodated. Andrew Friedman, 7106 W. Oceanfront, stated that the plans look great, but noticed that there would not be any pull -up bars, he urged the Commission to add these to the plan. Manager McGuire stated that she would look into having those added if possible. Chair Beek closed the public hearing Motion by Commissioner Skoro that the playground at Fern and Seashore be designated as a toddler playground for ages 2 -5 and replaced in FY 1999/00; and that the playground at Lugonia and Seashore be designated as a school -age playground for ages 5 -12 and replaced in FY 2000/01. City Council Policy G -3 — Preservation of Views – Director Niederhaus stated that in 1994 this policy was amended to add specific street addresses to preserve views. This policy is amended to be in accordance with the new G -1 Policy and to add additional streets to the list. Director Niederhaus noted that the Commission should have received a copy of a petition from homeowners on Carnation requesting that they be added to the list. In an effort to be consistent, all streets of the 200 block have been added to the list. Chair Beek opened the Public Hearing. Kent Moore, 210 Carnation, urged support of the policy. Parks, Beaches & Recreation Commission Regular Meeting March 7, 2000 Page 3 Chair Beek asked if there was a petition from the other streets listed on the revised policy. Mr. Moore stated that there was not but that it could be done if that was what was needed. Jan Vandersloot, 2221 E. 16u' Street, stated that what this City is facing with the approval of a policy like this is a de- forestation of trees. As trees die on these streets they will not be replaced. He stated that it seemed prejudicial to just have the 200 block of these streets listed, why shouldn't the 400 block be included? Bob Wynn, 1617 Port Abbey, stated that as a former City Manager, he is very aware of how important views are to City residents. He urged support of adding at least Carnation Avenue to the policy since a petition had been done and stated that the other street would follow also forward petitions if that was what is needed. Carter Wurts, 2700 Ocean Boulevard, stated that as a 29 year resident, this policy is very important to homeowners as many have been remodeled so that they have a view. He stated that SPON does not need to worry about deforestation, there are many more trees today than 29 years ago. Chair Beek closed the Public Hearing Motion by--Commissioner Skoro that City Council Policy be approved as amended but that only the 200 block of Carnation be added to the paragraph regarding the preservation of views. Motion fails for lack of a second. Director Niederhaus reminded the Commission that this would be an item on the City Council agenda on March 14. Commissioner Skoro stated that it is worthy to note that since 1994, Carnation is the only street that has petitioned to be added to the policy. Director Niederhaus stated that it just made common sense to include all the streets in the 200 blocks. He noted that the general consensus that the residents in the 200 block do not want street trees. Motion by Chair Beek to accept City Council G -3 Policy as received. Manager McGuire stated that they Waves only play on Sundays. Chair Beek opened the Public Hearing Kurt and Manna Jaye, 423 Fernleaf, urged support of co- sponsorship as they are a feeder team to the Corona del Mar High School Girls Softball Team which has been in decline. Marc & Jenna Reynolds, urged the Commission to support the co- sponsorship and stated that there is a age limit for Bobby Sox, this allows girls to stay competitive. Chair Beek closed the Public Hearing Commissioner Macfarland asked what was the reason for requesting co- sponsorship. Manager McGuire stated that it will give them to opportunity to sit in the meetings for the scheduling of fields, and that although they will no longer have to pay for the usage of the field it does require them to participate in the maintenance of them Motion by Commissioner Franklin to approve the request for co- sponsorship of the Newport Waves for a one -year trial period. Street Tree Redesignation List — Director Niederhaus stated that after many public meetings, notices to the public, regarding the revisions of the list, that staff has only received two responses. He noted that the Commission holds the list and that it should be reviewed every two to three years. He introduced the Andy Trotter, West Coast Arborist, consultant on the list. Commissioner Skoro complimented the staff on the thorough job of noticing the public. Chair Beek opened the Public Hearing Aldon Kelly, SPON consultant, stated that he did not agree with many of the choices of trees for specific streets and began to go down the list with his comments. Chair Beek stated that although the Commission welcomes his comment that it would be more appropriate for him to furnish them in writing to Director Niederhaus. Jan Vandersloot, 2221 16"' Street, stated that according to the list that 424 streets do not have the appropriate tree, according to his calculations, 86.4% of the approved street trees are wrong. He stated that he has great concern regarding many of the choices, and noted that there is a bias against specific trees such as the Carrotwood. Kay Mortenson, 1530 Miramar Drive, stated as the representative for the BIIA that they request the following three changes (1)that the street tree for Balboa Boulevard be changed to the Queen Palm; (2) that the Carrotwood remain as the street tree for East Ocean Boulevard; and (3) that the Magnolia remain as the street tree for Miramar. She stated that there is nothing wrong with expanding the tree vistas and appreciates the serious thought and work of this list. The changes proposed by staff will cause a massive change in the City treescape, because nearly all (85 %) of the streets in Newport Beach will have a change in their parkway tree. The staff seems to want to gradually eliminate the City trees as we know them, to be replaced essentially be smaller, untested trees. I suggest this list be more carefully scrutinized before being accepted, and that individual streets be changed, if and when needed, rather than the massive change proposed by staff. 1.Number of streets /street segments included in the "City Street Tree Designation List": 586 streets /segments 2. Number of streets /segments with currently designated tree species: 513 3. Number of streets /segments where the tree species is proposed to be changed: 437 4.
