I am in receipt of the amended escrow instructions regarding the application for harbor
construction, and fiinds being withheld in escrow for the work on the above property to
remedy the non -permitted additions to the dock at 311 Morning Star Lane. This
represents acceptable proof of intent to do the required work.
Once this office has received a copy of this signed escrow amendment, and the pier
transfer application form with both the Buyer & Seller signatures, along with the $ 185
balance due on the pier permit transfer fee, the pier permit will be transferred David and
Edwina Broderick.

Dear Sirs:
The City of Newport Beach Harbor Resources Office has received a request to transfer
the above noted pier permit for 311 Morning Star Lane. The structure was inspected by
the Harbor Resources Staff and we cannot transfer the pier permit until the following
deficiencies has been corrected and we have been notified of the corrections:
The electrical receptacle at the bottom of the ramp has one outlet that requires a GFI for
use in a water environment.
As noted in an earlier inspection this year, there has been additional dock footage added
to the original dock that was approved by the City when this structure was built. The
footage in question is attached to the dock directly under the ramp. The applicant must
either remove this section of dock or go into the Building Department and receive a
permit for this addition.
Please advise this department when the above deficiencies have been corrected. Call 644-
3043 if you require additional information in regards to this matter or to request a re-
inspection.

Dear Sirs:
The City of Newport Beach Harbor Resources Office has received a request to transfer
the above noted pier permit for 311 Morning Star. The facility was inspected on April 5,
2002. We cannot transfer the pier permit until the following deficiencies has been
corrected and we have been notified of the corrections:
A new Backflow Prevention Device must be installed at the facility. The purpose of this
device is to protect the domestic water system from being contaminated by seawater.
A drawing of an approved device and a drawing showing a typical installation is
attached.
The electrical receptacles on the pier/dock must be Gfl or Twist Lock for use in a water
environment.
There has been additional dock footage added to the original dock size that was approved
by the City of Newport Beach when this structure was built. This additional footage is
attached to the dock that is directly under the ramp. The applicant must either remove that
portion of the dock or apply for a permit to revise the dock. The City of Newport Beach
Building Department must approve the plans for the additional dock and issue the permit,
and the County of Orange Public Facilities & Resources Department must issue an
encroachment permit since this structure is over County Tidelands.
