Dear Bahman Bakhtar:
It has come to the attention of this Department that certain conditions on your subject property
constitute a violation of Newport Beach Municipal Code Section 10.50.020 (A, D, E) 20.60.030
and NBAC 105. 1. We are concerned about the following conditions:
Overgrown vegetation, trash and debris located on your subject
property whereby that vegetation has become a nuisance such that it
may be a fire hazard, or whereby it may be a harborage for
rodents/insects and other vermin, or whereby it has become unsafe or
unsightly due to lack of maintenance.
Fences, walls, hedges, uncovered decks, landings, patios, platforms,
porches and terraces and similar structures not more than six feet in
height, may be located within any required side yard to the rear of the
front setback or within any required rear yard other than those abutting
an alley.
Buildings or structures which are partially destroyed, partially
repaired, abandoned or which remain in the state of partial
construction or disrepair for more than three months, unless the
construction and repairs are being accomplished pursuant to an active,
open building permit.
Buildings, walls, fences or structures upon which the condition of the
paint or exterior finish has become so deteriorated as to permit decay,
excessive cracking, peeling, chalking, dry rot, warping or termite
infestation.

Landscaping, grounds, walls, fences, driveways, parking lots,
irrigation systems, or sidewalks which are maintained in such a
condition so as to become defective, unsightly or unsafe.
To correct these violations:
1. Please cut and remove all overgrown/dead vegetation, trim hedges in side yards so as not
to exceed maximum required six foot (6ft) height limit and provide/maintain landscaping.
2. Repair all rotted exterior decking, railing and siding.
3. Replace deteriorated dock and gangway ramp.
4. Repaint all exterior surfaces of structure.
5. Please obtain proper permits and approval for dock work and the interior construction of
your subject property.
Accordin2ly, because of these concerns, you are to correct the items indicated above within
ten (10) days from the date of this letter.
We would like to thank you for your cooperation and understanding in helping us to resolve this
matter in a timely and amicable fashion.

Dear:
It has come to the attention of the Marine Division that you have not completed the process of
transferring the harbor permit for the pier and dock bayward from the above named property.
The City of Newport Beach Harbor Permit Policy IO.B. States: "Whenever a permittee sell the
abutting upland property, a request shall be made to the City to transfer the permit. Forms for
this purpose may be obtained from the Fire and Marine Department. Failure to apply for a
transfer within 30 days from the date that the abutting upland property changed ownership will
result in air additional fee by the City"
To complete the transfer requires:
1. A backflow prevention device. See attached, This office should be notified when the
correction has been completed. Call 644-3043.
Since the transfer had not been completed the bill for annual pier permit fee has been going to
Mr. Randy Bohart and not to you, therefore, the bill has not been paid. The bill must be paid, as
soon as possible, but in the interest of fairness the late payment penalty will be waived.
Please remit the 1999 annual fee of $75 by the end of June.
Failure to comply with this request may result in a penalty assessment or the matter being turned
over to the City Attorney for further action.

Regarding your letter about my dock dated 12/g/98:
I moved to 409 Morning Star Lane in Newport Beach approximately 6 years ago, After
living there for about 2 years, we decided that, since we did not have a large boat and
we did have several small boats and jet skis, we needed a larger surface area of our
dock. I contacted Swift Slips at that time and asked him if he would fill in the head
portion of our dock, about 8 feet worth. There was a 4 -foot head, and now with the
additional 8 feet, there is a 12 -foot by 15 -foot section at the head of our dock where we
could store small sailboats, inflatables, rowers, etc. Swift stated that he installs most of
the docks in Newport Beach, and I assumed that he would take care of all necessary
items, including a permit if one were necessary. I never asked him to get a permit and I
never asked that he not get a permit. I just assumed that he would take of whatever was
necessary. He charged me by the square foot, and he did not give me any discount
whatsoever, even though he installed used floats, and now I find that he did not got a
permit. He charged me the same as if I had him build a new dock, only for the
proportionate amount of square feet.
At this tirne we are selling my house, and I need to take care of this situation. Please let
me know what I need to do.

The City of Newport Beach Fire and Marine Department has received a
request to transfer Pier Pern-dt 11504091 for the above-mentioned
property. The facility was inspected on December 7,1998.
We cannot transfer the pier permit until the following deficiency
has/have been corrected and we have been notified of the corrections:
1. A City approved anti -syphon device is required at the water
connection for the water supply to the pier and float. A sketch
showing the approved type of device and its installation is enclosed.
This requirement is in accordance with Title 17 of the California
Administrative Code.
2. The pier has been modified from the design originally approved
By the City Public Works Department. The size of the headwalk has

The City of Newport Beach Marine Department has recived a request
to transfer pier permit # 0115-409 for the property located at
409 Morning Star Lane Newport Beach, CA.
We cannot transfer the pier permit until the following
deficiencies have been corrected and we have been notified:

with Section 10--D of the Harbor Permit Policies it cannot be
transferred until it meets City requirements.

Dear Sir:
The City of Newport Beach has received an application to transfer
pier permit # 0115-409 fOr the property located at 409 Morningstar,
Newport Beach, California.
The structure was inspected on 4/8 /87 at which time it was determined
that the following deficiencies exist:
A City -approved anti -syphon device is required at the water connection
to the pier and float.

In accordance with Section 10-D of the City Harbor Permit Policies:
"All structural deficiencies must be corrected......", it will be
necessary for these to be corrected. A permit for any electrical or
plumbing work must be obtained from the Building Department of the City.
All other work requires a Harbor Permit.
Please advise this department when the above deficiencies have been
corrected.

for the pier and float at 409 Morning Star Lane (Harbor Permit 0115-0409- 1—
Newport Beach, is registered to Cecil H. Shirar.
A transfer application must be completed and a transfer fee paid
each time the permit has changed ownership.
Chapter 17.24.030 of the Municipal Code addresses the transfer of
a pier permit and rpads as follows:
"No person shall transfer apermit for a pier, float or
94milar structare granted under the provisions of this
chapter without prior written approval of the City."
Failure to pay the transfer fees can be grounds for revocation of.
the Harbor'Permit in accordance with Chapter 17.24.090 of the
Municipal Code.
