SUBJECT: CORONA DEL MAR STREETLIGHT BANNERS
RECOMMENDATIONS:
1. Approve the request of Corona del Mar Business Improvement District for the
installation of 44 double banners on City streetlight poles year- round. Installation
shall be on poles along both sides of East Coast Highway from Avocado Avenue to
Seaward Road. If approved, the installation of double banners will be subject to the
Public Works Department's conditions of approval
or
2. Deny the request.
DISCUSSION:
The Corona del Mar Business Improvement District (BID) has requested that 88 private
banners (double banners on 44 poles) be installed year -round beginning November 1,
2000 for a few years, to promote civic pride in the community. The banners will be
mounted on all streetlight poles along both sides of East Coast Highway from Avocado
Avenue to Seaward Road and two streetlight poles on MacArthur Boulevard (north of
East Coast Highway). See the attached Exhibit.
The BID plans to switch banners one to two times a year to reflect seasonal themes
(i.e., winter /spring - see attached sample banners). The Corona del Mar Chamber of
Commerce and Corona del Mar Residents Association support BID's banner proposal.
The applicant's request to install a total of 88 banners (44 double banners) will not
exceed the 100 banner limit allowed per City Council Policy L -16. However, BID's
proposal will not meet the following criteria in City Council Policy L -16:
1. BID's double banner per pole versus the single banner per pole concept
allowed per City Council Policy L -16.
2. BID's year round time of installation versus the thirty days maximum time
period, and only between September 1St and May 31St allowed per City
Council Policy L-16.
3. BID's banner size of 2.5 -feet wide by 8 -feet high versus the 2 -feet wide by
7.5 -feet high banner size allowed per City Council Policy L -16 .

In the past, the City Council has approved larger single banners per pole and longer
installation time than allowed per City Council Policy L -16.
• Larger single banners for the "Toshiba Senior Golf Tournament"
• A 12 -month installation period (year- round) for the Orange County Museum of Art
• A 47 -day installation period for the "Newport Beach Jazz Festival"
A precedent for permanent installations has in effect been set by the previously
installed flower banners along Coast Highway in Corona del Mar and the Orange
County Museum of Art Banners along San Clemente Drive in Fashion Island. City
Council has also previously approved "Free Flying" double flag banners per pole for
"The Taste of Newport." However, the City has never allowed the installation of double
banners mounted with top and bottom brackets on a single pole.
The previously approved larger Toshiba banners were 18.75 square feet in size (2.5-
feet wide by 7.5 -feet high). They were 25 percent larger in square footage than the 15
square foot banners allowed per City Council Policy L -16. The BID double banner
concept would total 40 square feet (two banners 2.5 -feet wide by 8 -feet high). This
would amount to a 167 percent increase in banner area.
There is no data available to show that the City poles can support the double banners
without jeopardizing public safety, thus a recommended condition is to have the
applicant or the applicant's contractor provide structural calculations to substantiate
their proposal. Wind slit/vent openings on the banners would ease the load during
windy conditions.
The BID has presented the following to support their request:
• Letters of support from the community
• A location in the City of Irvine where the larger double banners on a street light pole
are used
• A "Windbreaker Bracket System" for mounting the banners
Should the City Council decide to approve the request of Corona del Mar Business
Improvement District for the installation of 44 double banners year- round, staff
recommends the following Public Works Department conditions of approval:
1. No banners shall be installed on traffic signal poles.
2. The applicant shall provide on -going maintenance of the banners and brackets.
3. The contractor shall agree to indemnify and hold harmless the BID and the City of
Newport Beach for any liability associated with contractors, maintenance, design,
installation, and other activities related to the banners and /or brackets. Provision is
subject to approval of the City Attorney.

installation, and other activities related to the banners and /or brackets. Provision is

4. The contractor shall maintain a minimum of $1,000,000 in liability insurance from a
company with a Best's Key Rating Guide parameter of "A" or better, and a financial
size category of "VIII" or higher. The City and the BID will be named as additional
insured.
5. The banners shall conform to City Council Policy L -16 with the exception of the size
of banner, single banner per pole concept, and time of installation.
6. All banners and brackets shall require issuance of an Encroachment Permit from the
City of Newport Beach Public Works Department and California Department of
Transportation and comply with the Encroachment Permit conditions.
7. If needed, the City may require removal of some of the banners to allow other
organizations to install banners authorized under City policies at the same location
and during the same time period. This would require advance notice and
coordination with the applicant.
8. The applicant or applicant's contractor shall provide a street light pole structural
report for wind load created by double banners to substantiate their proposal.
Slits /vents may be needed to reduce the wind load.
9. Except for identification of Corona del Mar, or 'Welcome to Corona del Mar," the
banners shall be limited to non - commercial images only.

Dear Gil:
As a follow -up to our discussions with Rich Edmonston, we are attaching the following
information for your review:
1. Street map of Pacific Coast lEghway, from Avocado to Seaward through Corona del Mar,
showing the proposed placement of the banners
2. Sample designs of the banners we are proposing to install
3. The RFP we have submitted to Dekra Lite, a well- known, quality banner production and
installation firm, showing the descriptions and quality of the banners and brackets we are
proposing.
The purpose of these banners is a non - commercial effort on the part of the CDM B.I.D. to
promote civic pride in the community at no cost to the city. This is no different than the banners
that were put up a few years back with the notable exception that the quality of the banners, the
installation hardware to be used, and the installation itself will all be of professional quality versus
the prior volunteer efforts.
As mentioned previously, our objective is to have these banners in place in time for this coming
holiday season, beginning November 1 #. Like the Flower banners previously installed, these are
meant to be permanent in nature and will be rotated in and out depending on the seasons.
This is an extremely important initiative for our community and we want to make sure that we are
doing whatever it takes to move this through the required process as expeditiously as possible.

TEMPORARY BANNERS EXTENDING OVER
THE PUBLIC RIGHT -OF -WAY
FINDINGS AND PURPOSE
Temporary banners and signs pose risks to the public in the form of potential physical
obstructions in or over the right of way and by distracting an individual who otherwise
would, and should, focus on other users. The City Council also finds that, in the
absence of the size and number limits specified in this policy, temporary banners or
sign could reduce property values, adversely. impact land uses, and interfere with the
recreational objectives of visitors to the City of Newport Beach. A total prohibition on
the installation of temporary banners and signs is appropriate with the exception of the
provisions of this Policy and Chapter 20.67 of the Newport Beach Municipal Code
because there are adequate alternative means of communication for those wishing to
engage in commercial or non - commercial speech except for temporary real estate signs
and non - profit groups organizations conducting community wide events co- sponsored
by the City of Newport Beach and open to the general public. Finally, the City Council
has determined that the restrictions contained in this policy and the provisions of
Title 20 of the Newport Beach Municipal Code are the least restrictive means available
to accomplish the public safety, economic and aesthetic objectives of the City Council.
GENERAL PROVISIONS
Temporary banners and signs shall not be permitted within or over any public street or
pedestrian right of way with the exception of temporary real estate signs as specified in
Chapter 20.67 of the Newport Beach Municipal Code and banners notifying the general
public of a community wide event, open to the general public without charge,
conducted by a non - profit corporation or organization, and co- sponsored by the City of
Newport Beach. Temporary banners and signs shall be installed in strict compliance
with the provisions of this Policy and any conditions imposed on the permit by the
Public Works Director.
PERMIT PROCESS
A. Except as provided in Title 20 of the Newport Beach Municipal Code, no person
shall install any temporary banner or sign within any public right of way
without first obtaining a permit issued by the Public Works Director.

B. Applications for a temporary banner permit shall be submitted to the Public
Works Director on a form supplied by the City, and prior to 30 days of planned
installation date.
C. The Public Works Director shall determine if the application complies with the
standards specified in this policy.
D. The Public Works Director shall approve or deny the application within five (5)
working days.
E. The Public Works Director shall approve the permit if the application conforms
with the standards contained in this policy.
F. The Public Works Director shall deny the permit if the application does not
conform to the standards in this policy and shall give the applicant written notice
of, and the reasons for, the denial.
G. Permittee shall submit a $300.00 refundable security deposit to be applied to any
damages, repairs to standards or poles not corrected by permittee within 14 days
of banner removal or any special services required by City.
STANDARDS
A. Manner of Installation.
1. Permittee shall install no more than one hundred (100) banners;
2. Banners shall be no more than 2 feet wide and 7.5 feet high;
3. Banners shall not encroach on or above any portion of a right of way
utilized by motor vehicles;
4. No more than one (1) banner shall be installed on any pole or standard
and banners may not be installed between poles or standards;
5. The banners shall contain only the name of the permittee and the date,
time and the name of the event to be conducted by the permittee;

6. All banner brackets must be mounted at least fourteen (14) feet above the
ground surface;
7. All banner brackets must be installed using stainless steel band clamps
.and the brackets must be sufficiently strong to withstand wind -load
generated by ninety (90) mile per hour winds;
8. Poles or standards must be wrapped with forty five (45) ml thick black
rubber sheet or other pre- approved material under all steel brackets and
clamps and no portion of any bracket shall be in direct contact with the
surface of any street light pole or standard;
9. Banners shall be installed only at locations specified on the permit;
10. Permittee shall install and remove banners in strict compliance with the
traffic control, signage and warning device criteria specified in the
WATCH handbook and /or the Caltrans manual of traffic control;
B. Time of Installation.
1. Permittee shall contact the City Electrician of the Public Works
Department of the City of Newport Beach at least forty eight (48) hours
prior to the installation of any banner pursuant to the permit;
2. All banners and supporting material shall be removed within thirty (30)
days after the date of installation;
3. Banners may be installed only between September 1 and May 31.
C. Place of Installation.
1. Banners shall only be installed on City owned poles and standards;
2. Banners shall not be installed on any pole or standard which could create
sight distance problems for pedestrian or vehicular traffic;
3. Banners shall not be installed on poles or standards in any residential
district.

plan submitted with the banner application.

Banner Program Summary
Objective
To enhance the look, feel and community identity of Corona del Mar with a non - commercial
banner program adorning the light standards. We have wide support for this throughout the
community. Please see attached letters from the CDM Chamber and Residents' Association.
Fact Summary
• Area coverage — from Avocado to Seaward, both sides of East Coast Highway
• Number of poles — 44 (none of which will be at traffic light intersections) Ex. A
• Type of banner — these will be Corona del Mar Civic pride banners (Ex. B) and will
include the designs shown here as well as special community events such as the 5K
• Quality — we will be installing very high quality banners made of marine acrylic
fabric, double stitched and double looped for extra strength
• Size — 30" wide x 96" high, printed on both sides
• Placement — two banners per pole, 14.5' above grade per Cal Trans/city
requirements
• Installation — all installation and periodic removal/replacement/repair of banners
will be performed by a professional banner company with all requisite licenses,
permits etc. and a 48 hour service level agreement (see exhibit C for proposal and
qualifications of Dekra Lite)
• Attachment— Brackets are made of high quality extruded aluminum, banner poles
are fiberglass, will be mounted with protective coating for poles, and will include a
safety leash (see Ex. D for diagram of bracket attachment). Note: each banner is
independently supported by a bracket/pole combination and there is approximately 6"
of wind space between the pole and each banner.
• Duration —These will be year `round banners that will be switched out one to two
times per year depending on the season. Our initial schedule calls for the holiday
banners to be installed by November 1, 2000, to be replaced by the theme banners
(dolphins, sea life, flowers, welcome to CDM) after the I' of the year.
• Timing — 8/22: submission to Newport Beach City Council for approval
8/24: submission to Cal Trans for approval

It is my understanding that the city is in the process of reviewing a proposal submitted by the
Corona del Mar Business Improvement District to provide decorative banners for the light poles
along E. Coast Highway.
The Corona del Mar Chamber of Commerce Board of Directors has reviewed this proposal and is
in complete support of the banners. We believe this project will enhance the presence of our
business district and assist in mating a positive statement about the Village of Corona del Mar.
Also, this concept will help bridge the visual gap, due to the removal of the Fichus Trees, as the
new trees develop and additional trees are planted.

go a long way towards helping the Village realize our Vision 2004 Plan.

Fees
Dekra -Lite will follow the City's Procedures for Installation of Banners on
the Publics Right of Way, install to specifications, and administrate the entire
program so you have a one stop contact. We will pay for the necessary
business licenses provided we have knowledge of their amount prior to
entering into the final contract.
Consultant Selection Process
• Currently we have local open contracts requiring that specific procedures
are executed in our installations in the cities of Beverly Hills, Hollywood,
Chula Vista, Westwood, Solana Beach, Long Beach, Signal Hill, La
Mirada, City of Industry, El Cajon, and Los Alamitos, just to name a few.
• Although we have no way to predict or control vandalism, we do offer
prompt 48 hour repair service to remedy these unwanted instances.
• Cost estimates for repair are billed using time and materials of $65 per
hour for labor (includes boom truck, operator, drive time, and
insurance's). Materials are billed separately plus tax rate.
Consultant Selection Process
• Upon review of your codes and regulations, we will review and sign a
document stating that we understand and will demonstrate the guidelines
for use of Public Rights of Way for advertising.
Guidelines for Submittal
• No subcontracted labor is to be utilized.
• Your sales consultant also serves as your project administrator and point
of contact.
• Communications will be documented in a written or "express" format and
will be open for review by the City at any given time. This includes
proposals, memos, repair logs, insurance certificates, and contracts. All
accounting concerns are directed to Dekra - Lite's accounting department
for an expedited response.

Installations are scheduled upon receipt or order. A 50% deposit and
signed contract constitutes as an "order ". Repairs are guaranteed within
48 hours. Repair of damaged products may take additional time.
• All work completed while encroaching upon City property will be

• Illegal advertising or requests outside of city guidelines will be submitted
to Public works for advisement.
• We will ensure fair pricing and equal service is offered through
professionalism and price integrity. All designs and banner locations are

Windbreaker Brackets Systems continued...
You will also want to consider that the Wind Breaker system exceeds most
city and state specifications, assuring you of a safe and effective mounting
system.
Our brackets are tested to resist winds up to 70 m.p.h. If you have winds
greater than this, the banners are the least of you problems! Wind vents are
not reccomended on small street banners (36 ", 30 ", or 24" x 72 ", 84 ", or
9611). Wind vents will compromise the structure of these types of small
banners and will cause more harm than gain from wind tunneling. Wind vents
are used on large banners that span across the streets.
We can also offer a protective 3 ply vinyl wrap as a layer in between the pole
and our aluminum bracket shoe. This does protect the pole from minor
scratches, but is not used with brackets that are installed year round. Over
time vinyl wrap and even a close felt substitute will decay. It is reccomended
that no protective wrap be utilized with the Corona Del Mar application.
Comments
Dekra -Lite has the appropriate insurance coverage, and experience to perform
the proposed banner program.
The Corona Del Mar Business Improvement District (CDM BID) has a
detailed site plan showing proposed banner locations. In selecting
appropriate banner styles, the CDM BID carefully considered our diverse
customer backgrounds and concluded the following additional findings:
1- The proposed program does not adversely affect other signs within the
community or the surrounding area.
2- The proposed banners will not be detrimental to properties within the
vicinity.

3- The proposed banners do not obscure fire hydrants, traffic signs, traffic
signals, block motorists line of sight, or otherwise inhibit or interfere with
vehicular or pedestrian traffic.
4- The banners shall be installed via an authorized schedule only. The
installation firm provides any necessary service call within a 48 hour
period if necessary.
5- The bracketing hardware meets acceptable city specifications and the
banner dimensions are calibrated to the light standards size.
At this time there will be ample time to completely address any unanswered
questions and provide you the means to develop a comfort level with our
firm.

RE: Corona Del Mar Business Improvement District — Double Banners
Dear Mayor Noyes and Council Members,
This letter purpose is to provide you with an overview of why we are asking you
to approve the CDM -BID's request for double banners through our business
district, to hang from our City owned light posts.
Since we began the transition from unwelcome Fichus Trees to our new King
Palms and Hong Kong Orchid Trees, our business district has suffered somewhat
aesthetically. (Some say we look too bare). To compensate for this perceived
(and somewhat real) problem, we decided to add banners. As you can tell from
our proposal, those banners are unique symbols of our village, custom designed,
larger than usual for Newport Beach; and planned to hang longer than usual,
while we pass through this transition period. These quality banners will fill some
of the air space, take our eyes away from the older building facades, and help perk
up how we look.
During the banner days, we will add more trees with money the BID has saved
and the $50,000 you have so graciously added to this project from the city budget.
For that, we are very thankful. Further, as we move through these long vision
2004 planning days, we can demonstrate visibly to our businesses and residents
that something good is happening in their business district now. Let me
underscore that these banners are being made under our watchful eyes, by a
• quality vendor, to our impressive standards, unlike banners previously seen
around the area. You and we will be proud of the results.
We intend to start with banners for the holidays and then replace them with
unique designs featuring our Crown of the Sea logo at our entrances, a variety of
flower designs, sea -side designs, and dolphin designs. Care is being given to the
end results which will match up with our high standard of quality.
After the Vision 2004 plan passes through the planning approval process, and is
implemented, there may not be a need for banners as our eyes drop to the fabulous
improvements at the street level. Hopefully by then, most of our business owners
have improved their buildings and replaced their old signs with improved signs.
By then, too, our trees will have matured, there will be more of them, and
everything will be close to perfect.
That is our purpose and rationale. We do hope you agree. Thanks for considering
this proposal. We look forward to your unanimous support.
